inappropriate, and Hayden Gulch Terminal, Inc. submitted a new application
(dated December 19, 1992) to operate the coal loading facil.i ty pursuant to
the Regulations of the Colorado Mined Land Reclamation Board for Coal
Mining.
At the time of the December 1992 permit application submittal, HGTI
anticipated coal shipment commencing as early as June 1993. Permits or
permit applications required to operate the loadout facility were
transferred from the previous owner through the applicable regulatory
authority. The permitted coal processing capacity remained at 1.0 million
tons per year.
Because no additional operational disturbances were anticipated and
operational aspects will be consistent with past practices, environmental
assessments and operational findings contained in reviews of the previous
owner's permit (H-G Coal Company, Permit C-80-003) were directly applicable
to HGTI's permit application and future operation of the facility. An
additional 8.4 acres of disturbance was proposed at the time final
reclamation will be conducted to accommodate grading activities (i.e.,
slope reduction).
Peabody Coal Company operated the loadout for HGTI from January 1993 to
July 1994. Seneca Coal Company operated the loadout from July 1999 to
August 1996. HGTI has operated the loadout since September 1996.
On November 3, 1997, HGTI notified the CDMG that the Hayden Gulch Loadout
had been put into temporary cessation as a result of HGTI or its affiliates
not having an existing mine requiring the use of a loadout facility at that
time. In July 2000 the loadout was returned to active status as part of
Technical Revision TR-O5. TR-OS was filed with the CDMG to upgrade the
loadout facility to provide for railcar unloading (or load-in: 500,000 ton
per year unloading throughput) in addition to the permitted railcar car and
truck loadout operations (1,000,000 tons per year throughput - for a total
permitted combined throughput o£ 1,500,000 tone per year). The technical
revision provided for greater flexibility in the operation of the facility
and potentially provided for increased facility longevity. However,
anticipated market conditions, which prompted the load-in technical
revision, did not materialize and HGTI again placed the facility in
temporary cessation on October 14, 2001.
TR-06 2 Revised OS/OS
