As will be outlined <br />below, there are several problems with the application that need to be addressed andlor <br />corrected in order to meet the requirements of the Mined Land Reclamation Act and the <br />Mineral Rules and Regulations. The primary problem are the maps (Exhibits). Most of the <br />maps do not comply with the requirements of Rule 6.2.1(2). <br />The problems will be listed using the same format you used when you completed the <br />application. Specifically, I will follow Rule 6.4. If I do not mention a subsection of <br />Rule 6.4 then I did not find a problem. In addition, after each noted problem I will <br />prescribe a corrective action. <br />1. Rule 6.4.1: Exhibit A <br />Legal description of the permit area is described as Lots A-B-C-D yet all the <br />maps describe it as Parcels A-B-C-D. Since the Quit Claim Deed refers to <br />Parcel instead of Lot the legal description should be changed to <br />Parcels A-B-C-D. <br />2. Rule 6.4.3: Exhibit C <br />(a) Plat map shows Parcels A-B-C-D and all the surrounding lots which, <br />along with a list of owners, identifies all immediately adjacent surface <br />owners. This is okay. Your Quit Claim Deed shows the acreage for <br />Parcels A-B-C-D at 156.3 acres. Your application states your permit <br />area will be 90 acres. Pursuant to Rule 6.2.1 (2) you need to identity <br />and outline your permit area on all maps and Exhibits. ,p, RA/~'`~ <br />(b) The power line needs to be shown on the maps. }~ dV /'~~t `J <br />
