(6) As per rule 3.1.5 (7) Maximum slopes and slope combinations shall be compatible with the <br />configuration of surrounding conditions and selected land use. Since this is strictly a dry pit <br />operation, there will be no lakes, ponds, swimming pools or water involvement. <br />(7) The landowners and applicant's choice of reclamation is rangeland. The reclaimed azea will be <br />able to be traversed by farm machinery, but this is not essential to the final use. <br />6.1 Water <br />1. Hydrology and water quality. <br />This dry pit operation will have no effect on water rights or hydrology of the affected land or <br />surrounding azea both during mining and after mining during reclamation. <br />(a) Since there aze no existing water rights to be injured or affected by this operation,;t should not <br />be a conflict with applicable water laws. <br />(b) This dry pit operation will be incompliance with applicable Federal and Colorado Water Quality <br />laws and regulations. The applicant will apply for aCOG-50000 Stormwater Dischazge Permit after <br />submission of this application. <br />(c) There will be no dredge and fill activities with this operation to come under the purview of <br />Colorado and Federal requirements. <br />(d) there will be no temporary or lazge siltation structures to be removed from drainways after <br />disturbed areas are revegetated and stabilized. <br />2. Earth dams. <br />None aze necessary or proposed for this operation. <br />6.2.(3) Grouud Water. <br />The following information is supplied in response to S.B. 181 and this rule, which became effective <br />September 1, 1993. <br />It is stated several times in this application that this will be a dry pit operation with no effect on water <br />rights or hydrology. To that is now added "ground water". The applicant's operation plan should <br />eliminate the possibility of ground water contamination. (c) (i) in this section states: "There will be <br />no toxic materials involved that could be leached". There will be no fuel storage on site or other <br />"contaminants" that would affect underground water. Neither will there by any chemicals or acid <br />producing substances on site. The predominant substance will be clay, which is basically inert. <br />The applicant believes that they will be in compliance with the laws, rules and regulations affecting <br />both surface and underground water. <br />
