EXHIBIT N <br />SOURCE OF LEGAL RIGHT TO ENTER RFGEIUED <br />AGREEMENT <br />FEB 1 6 2007 <br />Division of iteGamation, <br />Mining and Safety <br />This agreement, made and entered into between Donald E. Bollish and Robert E. <br />8ollisb, 20512 County Road 35; Sterling, CO 80751 (Hereinafter referred to as "Ltssor'~ <br />acid McAtee Construcrion Co., 22o Edwards; Sterling, CO 80751 (~Tereinafter referred to <br />as "Lessee"J shall be as follows: <br />Lessor, in consideration of the agreements set forth herein to be <br />kept and performed by Lessee, and of the payment of royalties by <br />Lessee as provided herein, and subject to the terms, conditions and <br />provisions rnntained herein, leases to that certain tract of land <br />situated in Section 30,T.9 N,R 52 W, of the 6`" PM in Logan <br />County, consisting of 45 acres, more or less. Known and described <br />as Bollish Pit Number 1, more particularly described in the Special <br />112 Constntetion Materials permit Application submitted to the <br />State of Colorado, Division of Minerals and Geology, and the <br />Deparmient of Natural Resources. Incorporated herein and made a <br />part hereof, together with the rights of ingress and egress to and <br />from said tract, as firrthar set forth herein, for the purpose of <br />quarrying, mining, removing and marketing there from all sand, <br />gravel, rock, and soil surrounding same, alI of which are referred to <br />as minerals. <br />2. TERM 01= LEASE: This lease shall be in effect for a period of <br />five (5) years from the date hereof. Lessee shall have the right and <br />opfron to renew the lease until the supply of sand, gravel and rock <br />commercially recoverable from the subject tract shall be <br />exhausted. If lessee desires to renew the lease, according to the <br />terms set forth herein, lessee shall give written notice to lessor <br />within 60 days of the expiration of this lease, addressed to Robert <br />E. Bollish and Donald E. Bollish, 20512 County Road 35; Sterling, <br />CO 80751, or as otherwise directed by lessor in writing. <br />ROYALTIES: Lessee shall pay to lessor, as royalty <br />~or each ton of material removed from the premises. <br />It is agreed that the royalty amount <br />shall be reviewed armually an s to 1 be subject to negotiation <br />between the parties hereto. The quantity shall be determined after <br />the materials aze loaded in trucks. Beginning one month after <br />lessee has first removed materials from the premises lessee shall <br />forward to lessor monthly reports showing the quantity of <br />materials removed during the precedutg month, according to scale <br />tickets, with dates of loading. <br />46 <br />
