The following issues need to be <br />resolved before the Division of Minerals and Geology (DMG) can consider approving your <br />application: <br />1) A written commitment to a topsoil salvage and replacement range is still needed. While the <br />figure of 14" of topsoil is mentioned in several places within the application, it is never <br />specifically cited as the amount to be replaced on the reclaimed slopes. A minimum depth of <br />/topsoil must be comitted to prior to approval of the application, in accordance with Rule <br />6.3.4(1)(c)(i) of the Construction Materials Rules and Regulations. <br />2) In Exhibit D, Mining Plan, on p. 26, it is mentioned that topsoil will be stockpiled along the <br />northern and western boundaries to prevent runoff from the undisturbed areas from entering the <br />Phase I process azea. Only overburden may be used in the drainage berms surrounding the <br />temporary site. This mistake has been corrected on Fig.4, which shows the new irrigation <br />drainage paths and only mentions the use of overburden in the 2' berm surrounding the site. <br />Please confirm that no topsoil will be used in these berms, in accordance with Rule 3.1.9(3). <br />,3) In Exhibit D, Mining Plan, p. 45, paragraph (3); please change the last sentence to read: "If <br />any subsurface water is encountered, the Division and the Office of the State Engineer (OSE) <br />will be notified immediately to determine the best course of action." <br />4) DMG is requesting a commitment to a specific seed mix for topsoil stockpile seeding. Exhibit <br />Reclamation Plan, p.55 states [hat vegetative cover will be established to preserve stockpiles <br />v' that are not replaced in "a reasonable period of time." Rule 3.1.9(1) requires seeding of all topsoil <br />stockpiles left in place longer than one growing season. Please commit to this and to a specific <br />seed mix and seeding rate for the stockpiles. <br />
