Waters of the United States
Waters of the United States (other than wetlands) were identified within the Brantner
Ditch and the Brighton Ditch, both irrigation supply canals. Both ditches originate to the
south at the South Platte River and receive flow contributions from natural drainages
upstream of the project site. Neither of the ditches is slated for disturbance.
Non-Jurisdictional Wetlands
Wetlands within the project fill azea included two sideslope seeps located below the
Brantner Ditch and an ephemeral depression pond located near the southwest boundary of
the site. It has been the opinion of the U. S. Army Corps of Engineers Omaha District that
wetlands created by man-induced ircigation that would revert to uplands if the ircigation
activity were to be terminated do not fall under Corps jurisdiction. Based on their
topographic positions and field observations, it was concluded that these features would
revert to upland vegetation if irrigation water were terminated. Additionally, none of the
wetlands are surface connected to a tributary system nor are they adjacent to the South
Platte River alluvial aquifer. For the above reasons, the features were concluded to be
non-jurisdictional.
If I can provide additional information or clarification in assisting your evaluation of the
delineation or concurrence with our conclusions regarding jurisdiction, please call me at
your convenience.
Sincerely,
Michael S.
