Mountain Coal Company SPCC Plan <br />f. West Elk Mine February 1993 <br />I. DISCUSSION <br />Authority <br />The Spill Prevention Control and Countermeasure Plan (SPCC) for Mountain Coal <br />Company (MCC) has been prepazed in accordance with Environmental Protection Agency <br />(EPA) Regulations 40 CFR Part 112 and Colorado Department of Health NPDES Permit <br />No. CO-0038776 (See Appendix A). <br />Purpose <br />To help ensure coordination of timely, effective response activities by MCC, various <br />State agencies, and other organizations to releases of oil which enter, or threaten to <br />enter, waters of the State and releases of hazardous materials. <br />Definitions <br />"Hazardous Material" is any substance or mixture of substances having properties <br />C~ capable of producing adverse effects on the environment or health or safety of a human <br />being. <br />"Hazardous Material Spill" means the release of a hazardous material in amounts <br />exceeding its CERCLA Reportable Quantity (RQ). The release must be reported to the <br />National Response Center, the State Response Commission, and communities likely to <br />be affected. See Appendix B for information regarding hazardous materials and their <br />RQs. <br />"Oil" means oil of any ]dnd or in any form, including but not limited to, petroleum, fuel <br />oil, sludge, oil refuse, and oil mixed with wastes other than dredged spoil. <br />"Oil Spill" means a dischazge of oil into or upon the Waters of the State or adjoining <br />shorelines in harmful quantities, which include discharges that: <br />1. Violate app~icable water quality standards; or <br />2. Cause a film or sheen upon or discoloration of the surface of the water or <br />adjoining shorelines or cause a sludge or emulsion to be deposited beneath <br />the surface of the water or adjoining shoreline. <br />"Waters of the State" shall mean all permanent and intermittent defined drainages and <br /><. lakes and reservoirs which aze not man made retention ponds used for the treatment of <br />1 <br />
