Submission of Incorrect oc Ineamolete Inforaaclan <br />~~• <br />Iihere the pernictee failed co submit any relevant facts La a pernit <br />application, or subaicced incorrect information in a permit <br />application or report co tae Division, the pernictee shall promptly <br />submit the relevaac'appllcation information which was not subclcced <br />or nay additional iaforrat!an needed to correct nay erroneous <br />lnforration previcusly subcicced. <br />S. Hyvass <br />The pernictee may allow any bypass to occur which does not cause <br />effluent limitations Co be exceeded, but if and only if 1t is for <br />essential maintenance to assure efficient operation. <br />Bypass is prohibited, and the Division may take enforcement action <br />against a perxiccee for bypass, ucless: <br />a) Bypass xas unavoidable co prevent loss of life, personal <br />- injury, or severe property damage; <br />l <br />b) There vere no feasible alternatives to the bypass, such as the <br />use of auzi'_iaty creataeat facilities, retention of untreated <br />wastes, or ~iaceaance during normal per±ods of equipment <br />downtime. This condition is not satisfied if the pernictee <br />could have ins called adequate backup equ±pmenc co prevent a <br />bypass which occurred during normal periods of equipment <br />docvcime or preventative maintenance; and <br />l• <br />e) The pernitcee submitted notices as required is 'Bypass <br />Notif±catioa", Part II.A.6. <br />6. Bvnass Nocificaclon <br />If the pernictee knows is advance of the need for a bypass, a notice <br />shall be submitted, at least ten days before the date of tae bypass, <br />to the Division and the Eaviroanental Procecclon Agency (2?A).
