19. Fertilizer application within Phase E is described in R-14. <br />20. The range of depth of applioable topsoil replacement is corrected in the attached <br />revised exhibits to read 6-8". <br />21. The attached revised Exhibit E, R-13, shows contour intervals sufficient to <br />represent reclaimed slopes and gradients. Identification of the features referenced <br />in this list item is shown on the same attachment. <br />22. As discussed earlier, the owner/operator has withdrawn its proposal to create: a <br />post-use reservoir in Phase D. <br />23. The relevance of the two plats included with the original application was simply <br />to illustrate the intended post-mining use of the subject property. These plat<, have <br />been submitted to the La Plata County Planning Department as part of a land use <br />application. The commercial site depicts a retail landscape materials outlet. <br />24. The withdrawal of the originally proposed dewatering within Phase D eliminates <br />the disturbance to groundwater in this phase of mining. <br />25. In response to this concern, a wetland assessment and delineation study was <br />completed. A copy of this report is attached as R-25. At this writing a <br />determination of jurisdiction by the U.S. Army Corps of Engineers has not t een <br />received. Compliance with this pending determination will be made. <br />With the omission of dewatering methods within Phase D, it is not now <br />anticipated that the owner/operator will mine in or through an aquifer. <br />26. As with the above concerns, no dewatering is proposed and therefore no <br />drawdown of groundwater is anticipated. <br />27. The Dashner Ditch #1 is shown along the eastern permit boundary on revises <br />Exhibit C, (R-2). This unrecorded ditch serves the subject property, the <br />Fassbender property and ends within the La Plata County/ City of Durango <br />property to the south. A minimum of twenty-five foot setback is proposed west of <br />this ditch to provide protection during mining within Phases A, B and C. <br />28. It is the intent of the owner/ operator to utilize the now approved commercia l well <br />for water necessary for dust mitigation for aggregate processing and the haul <br />roads within the affected lands. This commercial well permit allows for 7 acre- <br />feet per year at a rate not to. exceed I SGPM. It is anticipated that mining <br />operations, including loading/ shipping activity to occur 300 days per year. <br />Utilizing 6.5 AF of water per year would then provide an average of 7,000 gallons <br />of water per day for the intended operational uses. It is further proposed that water <br />storage tanks be located on the property to ensure demand is met. <br />
