Commissioner Mitchell asked who initiated the request and vas advised <br /> ens[ it had been by the Company oath no outside influence to do so. John FSSher of the <br /> Pla nninq Department stated the application wee complete and that stn Ef had reviewed all <br /> documents submitted to the state and you ld recomment approval. Commissioner Mitchell felt <br /> the 550 fee should he refunded the petitioner as he vas in operation before approval of <br /> location was required and through this petition he vas bring the operation into compliance <br /> v nth the County's regulations. There were no further comments or questions Croni the <br /> audience and no one appeared in apposition to the petition. She Chairman called for a <br /> motion. Commissioner Mitchell moved that the Board of County Commissioners approve cne <br /> location of a mineral extraction operation as petitioned by Schmidt Construction. [nc., <br /> located in portions of sections 12, 13, 14. Z3 and 24, Township 16 South, Range db s+est. <br /> E1 Paso County, containing 1215 acres, more or less, and chat cne petition fee of 550 be <br /> waived and refunded, and that the tuning requirement be valved. Commissioner Vieth secon- <br /> ded the motion and on being put to voce vas carried. <br /> Commissioner Johnson returned to [he meeting. <br />Mr. H. v. Halter, District Mineral Engineer Eor District Z of the Colorado state <br />Highway Depar anent, vas at the meeting in support of the petition by the Colorado stn ce <br />Highway Department and Iva Mae Ryan for approval of location of a mineral extraction opera- <br />tion and explained that the materials extracted woo Ld he used on the Widef fie ld Protect. <br />JoRn Fisher of the Planning Cepa rtmen[ stated the application vas complete: that all ad7o sr <br />inq grope rcy owners had signed in favor of Che petition and the Planning Commission had <br />given unanimous approval. There were no further comments and no one vas present in opposi- <br />tion eo the petition, and there being no further discussion the Chairmen called for a <br />motion. Commissioner Mitchell moved that the Board of County Commissioners approve the <br />oecicion of Colorado State Highway Department and Iva Mae Ryan for approval of location of <br />a mineral Extraction operation located in a portion of Section 70, Township 15 s, Range 65 <br />toes[, E1 Paso County, containing ZO acres, more or less; further, that the request for a <br />va iver eo the zone be granted. Commissioner Johnson seconded the motion and on being put <br />to voce vas unanimously carried. <br />• The petition of the Colorado State Highway Department and the Town of Green Mountain <br />Fa11s Eor approval of location of a mineral exczac cion opera coon vas then discussed and <br />.1r. H. H. Halter of the state Hi.q hvay Department represented the petitioners. Mr. Halter <br />stated the materials would be used in connection with the Cascade-Green Moun [sin Falls <br />oro7ec t. John Fishez of the Planning Department stated the application vas complete and <br />adjoining property owners contncts; that the Forest Service propescy vas on three sides <br />of the proposed location and they had not commented and Che property owner on the south vas <br />. in favor, and the Planning Department recommended approval. There vas no one present in <br />opposition to the petition and there being no further discussion the Chairman called for a <br />~o cion. Commissioner Johnson moved that the petition of Colorado ste to Hiqhvay Department <br />and the TOwn of Green Mountain Falls Eor approval of location of a mineral extraction <br />ooe ra [ion located in a portion of Section 7Z, Township 12 south, Range 68 Heat. E1 Paso <br />County, and containing ZO acres, more or less, be approved; further, [hat the reeuese for <br />a waiver to the RT Residential Topographical Oiscr ict Sane be granted. Commissioner <br />Yatcne ll seconded [ne motion and on being put to vote vas unanimously carried. <br />The petition of Fountain Sand and Gravel Company for approval of a mineral extraction <br />o'etat ion was presented to Che Board for tons ad erataon, and Mr. Bob Sack of Fountain Sand <br />and Gravel Company vas present in support of the pe cition. Mr. Sack explained that the <br />Location vas east of the Colorado springs propane plant and would not be extracting arou rd <br />t..^.c natural gas pipe lines: that the minerals would he used by the paving company and nor <br />for comma cc ial purposes: you ld not be changing the channel on Sand Creek, and had access <br />north of Markshe Efel Road. John Fisher of the PLann inq Depattmenc sea cad that the petition <br />vas comp lace and conformed to all requirements Eor approval of location: that adtoinanq <br />prooerty owner had signed in favor of the petitaen antl the Planning Department recommended <br />approval. Commis sooner Johnson seconded the <br />motion and on being put to vote vas unanimously carried. <br />The pecicion of Fountain Sand and Gravel Company Eor approval of Location of a <br />mane ral extrac cion operation adjacent to its existanq operation in Chapel Halls vas pre- <br />sented to the Board for discussion. Mr. Bob sack eppeered Eor the peciClon and scared <br />they had submitted their plan to the Land Reclamation Bureau in Denver and also had a <br />• lease requirement seating they must work vi ch Cimarron Cocporat ion to leave the sire level <br />for boa ldab le sites: that they had a ]-year permac and vas strictly en extr action operation <br />and no processing ac ell. Sohn Fisher acated Che application vas complete and that <br />Cimarron Corpo cation had sayned in favor of the petacaon; that there vas no vasab le impact <br />from the opt racao n: access co property vsa very good one would recommend approval.
