• 2.05.6 <br />The applicant has alternative sources of water to mitigate the impact mining <br />may have on the quantity of surface and ground water within the permit and <br />adjacent area. The applicant controls 3,750 shares of Class I and 960 <br />shares of Class II stock in the Deer Trail Ditch Company and 782 shares of <br />Class II stock in the Fire Mountain Canal. The applicant also controls the <br />right to use 0.5 cfs decreed to the Deer Trail Ditch for power and mining <br />purposes with date of appropriation of February 15, 1907. <br />(a)(iv) The proposed floor elevation of the D-Seam and B Seam mine entries at the <br />portals is 6878 and 6,640 feet respectively. Map 10, Upper Perched Water <br />Zone -Mesa Verde Formation, shows the elevation of the ground water in <br />the vicinity of the portals to be above the proposed portal elevation. <br />Therefore, gravity discharge of water from the portals is possible. See <br />section 2.05.4(2)(8) for portal sealing options. <br />The quality of water that may discharge by gravity from the mine is unknown. <br />• A one time measurement of the mine inflowtaken on May 11, 1998 indicated <br />a flow of less than one gallon per minute, a pH of 8.1 and a conductivity of <br />2748 umhos/cm. The quality of water that is discharged from the West Elk <br />Mine, Somerset Mine and the Bowie No. 1 Mine apparently satisfies the <br />water effluent limitations of 4.05.2 and all applicable State and Federal water <br />quality standards. The discussion presented under Section <br />2.04.6(3)(a}(iii}(C} concludes there is no acid forming properties in the coal <br />or surrounding strata. Therefore, the applicant should have no problem <br />discharging water from the mine without treatment. If for some reason <br />treatment is required, it will be performed as necessary to assure the gravity <br />discharge of water from the mine satisfies the water effluent limitations of <br />4.05.2 and all applicable State and Federal water quality standards. <br />• <br />P R-07 <br />2.05 - 69 - o2io3 <br />APPRouEn <br />S/jz/a3 <br />
