2.03.6 Right of Entry and Operational Information <br />• -- <br />The documents shown in Exhibit 1, Right of Entry Documents, show the <br />legal right which Mt. Harris has to enter and use the permit area. This <br />document shows that Mt. Harris leases the surface which it uses in <br />connection with the coal loadout facilities. Lease agreements have been <br />completed with the Denver & Rio Grande Western Railroad for use of the <br />adjacent railroad right-of-way for loadout purposes. <br />2.03.7 Relationship to Areas Designated Unsuitable for Operation <br />The permit-area is not within an area designated unsuitable for surface <br />operation activities as defined in Rule 7 or 30 CFR 764 and 765, or <br />under study for designation in an administrative proceeding under Rule 7 <br />or 30 CFR 764 and 765. <br />2.03.8 Permit Term Information <br />• Mt. Harris has submitted information within this application to cover <br />operations of the loadout facility for a projected production rate of <br />approximately 250,000 tons per year; however Mt. Harris does not <br />anticipate that this production rate to exceed 250,000 during the life <br />of the operation. In fact, production for 1985 and 1986 is projected to <br />be less than 10,000 tons per year. <br />Only approximately 9.75 acres have been affected by Mt. Harris; no <br />additional land is planned to be affected during the entire future life <br />of this operation. The facilities for operation of the coal loadout <br />facilities are shown on the Facilities Map (Map 5). <br />The initial permit term will be for a five year period. Prior to the <br />end of the initial permit term, Mt. Harris will apply for an additional <br />five year permit term. The life of the Mt. Harris coal loadout facility <br />is expected to be for 15 to 20 years depending on coal marketing <br />• conditions.
