Shale underlies the gravel deposit.
(D.) Topsoil is separated from overburden or fill dirt. As
we have discussed, some of the topsoil is removed and sold while
some is retained to be used in the reclamation process. Overburden
or fill dirt is also utilized in the reclamation process and
experience has shown that when subjected to one to two years weather-
ing it is adequate for utilization in the reclamation process.
(E.) As stated above, not all removed topsoil is stored for
future use. However, sufficient topsoil is salvaged and stockpiled
so as to result after redistribution in a layer six inches to eight
inches deep in areas to remain above water after land forms have
been shaped by placement of the overburden.
(F.) As we have discussed, the pit is dewatered during the
mining process, but the water is retained on the site and thus no
NPDES permit is required.
Exhibit E
(A.) The Reclamation Map now shows that the pond bank will
have maximum 3:1 final slope. The slope will vary from 3:1 to
approximately 5:1 in some locations (including pond islands) so
as to permit wildlife access to the habitats.
(B.) Cottonwood trees will be replanted on the site to replace
those which may be removed from areas where trees presently exist
which will be above water line after the reclamation process.
With respect to your concerns on seed mixture, we have
again consulted with Mr. Albert Yoxall of the Soil Conservation
Service of the Department of Agriculture. He reviewed your sugges-
tions and generally approved them. He indicated that he would
suggest that Russian wild rye be required only if available since
he has informed us that it is sometimes hard to find. He suggested
that we not use any switch grass and that western wheat grass be
