Michl, Lloyd, City of Brighton <br />The applicant has stated in response to an adequacy item regarding this issue that they are aware <br />that, in accordance with Rule 3.1.5(9) of the Construction Materials Rules and Regulations, if <br />any offsite material is used as backfill, a notarized letter will be submitted to the Division <br />indicating the materials are inert. The applicant has agreed to comply with this Rule regarding <br />back filling of material imported from offsite. This issue was raised in response to the <br />applicant's statement in the application that materials from its other operations may be processed <br />at this proposed operation's plant. This objection was in regard to backfilling reject materials <br />separated from material extracted and imported from the applicants other operations. <br />
