The combination of all these practices should <br />be adequate to protect the ditches from erosion and sedimentation. <br />A slurry wall will be constructed around Phases 3 and 3A (The extraction Phases nearest the <br />ditches) before any dewatering is started. The dewatering will only remove water from the <br />extraction area and there should be no hydrologic effect on either of the ditches. <br />The Division has reviewed the applicant's slope stability analysis and agrees with the proposed <br />setback distances for extraction from the Brighton ditch. The Brantner ditch is far enough away <br />to not be a concern. <br />The Brighton and Brantner Ditch Companies were notified of the proposed permit application, <br />by the applicant. Neither company provided any comments to the Division. <br />5. Has the Applicant proposed measures to minimize impacts to the hydrologic balance of <br />Marilyn Kent's water well? (Rule 3.1.6(1)) <br />Marilyn Kent <br />In the adequacy review of the original application the applicant was required by the Division to <br />agree to mitigate any negative impacts to the water supply of neighbors within 600 feet of <br />affected land, caused by the mining operation. The 600 feat distance includes Marilyn Kent's <br />property and well. <br />The applicant has agreed that owners of wells within 600 feet of extraction cells will be <br />contacted and asked to sign a 600 Feet Well Spacing Statement. If the owners indicate that the <br />wells are in use, the applicant agrees to attempt to measure well depth, pumping rate, pumping <br />water level, and non-pumping water level prior to mining, and if requested, the applicant will <br />attempt to measure water levels in these wells quarterly prior to mining. <br />To establish ground water baseline the applicant has installed monitoring wells at the site. The <br />Division has reviewed and approved the monitoring plan. <br />The Division has also reviewed and approved the applicants plans to identify any in-use well <br />negatively impacted and to mitigate the impacts. <br />The applicant will also have to comply with State water laws and the Rules and Regulations of <br />the State Engineers Office in regard to any negative impact on Marilyn Kent's water rights <br />regarding her well. <br />
