ISSUES The following is a description of the issues, as identified by the Pre-Hearing <br />Conference Officer, a list of objectors raising each issue, followed by the <br />Division's rationale for recommending approval. <br />1. Has the Applicant Rrovided an effective Alan for stabilization and protection of the <br />stockpiled material from wind erosion? (34-32.5-I 16(4)(ill <br />Wayne C. Muhler, B. Michl Lloyd, City of Brighton <br />This issue was in regard to stockpiles planned for an area near Mr. Wayne Muhler's property. <br />The Division also had a concern about erosion in that area and required the applicant to address <br />it not just for the potential of wind erosion but also water erosion. The division was particularly <br />concerned about the erosion of stockpiled material in the West Fill Area. The concern was that it <br />appeared the stockpiles were planned to be 30 feet high with lh:ly slopes and that such slopes <br />would be very erosive. <br />The applicant has agreed to create stockpiles with slopes no steeper than 3h:ly and to seed the <br />stockpiles with a temporary cover crop to protect them, before final reclamation. These practices <br />should be adequate to control excessive wind and water erosion of the stockpiles. <br />The applicant has added to the application gassed screening berms (topsoil stockpiles) 10-12 <br />feet high at the edge of the permit area adjacent to Mr. Muhler's property. These berms will <br />have 4h:ly slopes and should be even less erosive. The grass seed mix and seeding rate to be <br />used was planned by the local Natural Resource Conservation Service office. <br />2. Has the Applicant provided an adequate timetable and map to establish the relationship <br />between mining and reclamation? (Rules 6.4.4(1)(e), 6.4.5(21(e) and 6.4.6) <br />Wayne C. Muhler, B. Michl Lloyd, City of Brighton <br />The applicant's original application adequately addressed this issue with a table listing the time <br />frames expected for mining and reclamation of each Phase of mining. However, the applicant <br />mentioned several times in the application that the water storage reservoirs will be created by <br />concurrent reclamation without describing what was meant by the term "concurrent." The <br />Division asked for clarification. The applicant's response was that when an area is completely <br />mined out from grade to bedrock, side slope construction will begin on each section <br />(approximately 800 feet wide or approximately 30 acres) while extraction is beginning in the <br />next contiguous area or consecutive Phase. <br />
