RATIONALE for RECOMMENDATION for APPROVAL WITH CONDITIONS OVER <br />OBJECTIONS, AGGREGATE INDUSTRIES -WCR, INC., TUCSON SOUTH RESOURCE <br />112c PERMIT APPLICATION, FILE NO. M-2004-044 <br />INTRODUCTION <br />On December 29, 2004, the Division of Minerals and Geology (DMG) issued its <br />recommendation for approval, with conditions, of Aggregate Industries' Tucson South Resource <br />112c regular permit application. This document provides the Division's rationale for <br />recommending approval over objections raised by individuals and the City of Brighton. <br />Aggregate Industries-WCR filed a 112c permit application for their proposed Tucson South <br />Resource mine, on July 2, 2004. The applicant proposes to mine sand and gravel from the site, <br />which is about %: mile west of the City of Brighton, Colorado. The site is in the flood plain on <br />the west side of the South Platte River. The property is owned by Aggregate Industries and is <br />located in portions of Sections 1 and 12, Township 1 South, Range 67 West, Sixth Principal <br />Meridian. The proposed permit area is 291.5 acres of which approximately 193 acres will be <br />involved with sand and gravel extraction. The remainder will be used as a fill area (34.5 ac.) or <br />will be in set back and undisturbed areas (64 ac.). The extraction azea is proposed to be mined as <br />Phases 1, 2, 2A, 3, and 3A. Phases 2 (81.3 ac.) and 3 and 3A (67.2 ac.) are proposed to be <br />reclaimed to water storage reservoirs contained by slurry walls. The reservoirs would be one on <br />each side ofTucson Street, an Adams County road. Phase 1 (15.9 ac.) and Phase 2A (27.2 ac.) <br />are proposed to be wet mined and then used for deposition of processing fines after the sand and <br />gravel resource has been extracted. The final land use of these two areas is planned to be <br />wetlands or uplands depending on the depth of fines deposition. A sixth area (West Fill Area), <br />which is above the flood plain to the west, will not be mined but will be used for storage of <br />overburden, mud lens and topsoil materials. These materials would be used for reclamation, sold <br />or reclaimed in place. <br />The Brantner Ditch, Brighton Ditch and a United Power Company overhead power line cross the <br />permit area in their respective easements. <br />Aggregate Industries has proposed a setback for their operation from the South Platte River equal <br />to that requested by the Urban Drainage and Flood Control District. <br />OBJECTORS <br />Wayne C.
