Land stabilization and reclamation shall be completed within three <br />(3) years after the date the operator advises the board that reclamation <br />i has commenced. Tl~e operator shall advise the board on July of each <br />year as to any reclamation undertaken in the proceeding 12 months. <br />Sucli notification shall be in the form of a map as required by C.R.S. <br />1973, 34 32 111(a). If the property is sold, leased or transferred in <br />any manner, the new owner, lessee, or person having control, must file <br />a request to succeed operator (LRB Form 7) with the Colorado Land <br />Reclamation Board of with the Commissioner of Mines, and shall agree to <br />be bound to the unexpired period of the three year term. <br />~. <br />20. Erosional damage to the reclaimed areas as caused by severe thunderstorm <br />or other natural causes which, in the opinion of the board, could <br />jeopardize tl~e future success of reclamtion shall be controlled as soon <br />as is practicable by refilling, compaction and reseeding of the eroded <br />areas as well as reseeding any vegetation disturbed during the erosion <br />control process. <br />I 21. In the evetirof severe drought that prevents establishment of vegetation <br />and for which there is meteorlogical and/or agrophenological evAidence <br />from the area within fifteen miles of the mine that supports the <br />contention of drought 1' itation to recla~ion success, the 3 year term <br />for completion of reclaion shall be extended one year for each growing <br />' ~ season during which drought conditions exist continuously for not less <br />than three-foutths of [he number of days of the average growing season <br />- as determined by the nearest official United States Department of Commerce <br />weather station. <br />22. All refuse shall be disposed of in a manner that will control stream <br />pollution, unsightliness, or deleterious effects from such refuse, and <br />water from the mining operation shall be diverted in a manner designed to <br />control siltation, erosion, or other damage to streams and natural <br />watercourses. If the operator plans to discharge into a waterway, then <br />a permit to discharge into same shall be obtained from the Division <br />of Administration, Colorado Department of Health. <br />23. Operator shall furnish the Land Reclamation Board a performance bond <br />in the amount of dollars to insure that the work required <br />herein will be accomplished. <br />25. If the board determines that the requieements of reclamation have been <br />met in their entirity, the bond shall be released, <br />(~ i .. , <br />26. Through periodic inspection by the Land Reclamation Boardr~/their <br />representatives t}ie progress of the reclamation project shall be <br />monitored. If the operator is found to be in non-compliance with any <br />portion of this permit or any part of the Colorado Open Ptining Land <br />Reclamation Act, C.R.S. 1973, 34-32-101 et seq., the board shall notify <br />the operator of such violation and shall attempt, by private conference, <br />conciliation, and persuasion, to remedy such violation. The operator <br />` shall be allowed ten days from the date of notification to remedy the <br />I violation. If the operator has not remedied the violation in the ten <br />day period, the board shall require the operator to appear at a hearing <br />before the earliest meeting of the board not less than thirty days <br />after the date of the notification of the hearing. After the hearing <br />the board shall enter such order as it deems appropriate to effectuate <br />the purposes of the Colorado Open Mining Land Reclamation Act and shall <br />forthwith mail a copy thereof to said operator and the operator's <br />attorneg of record, if any. If such order of the board is not <br />complied with in the required time, the board may request the Office of <br />the Attornep General to commence proceedings under section 34-32-113, <br />C.R.S, 1973. <br />
