The permit area is s8i situated within those portions of sectnon 2 and 3, <br />T15S, R66W, 6th P.M., E1 Paso County, Colorado, outlined in red on Continental <br />Engineers map ~k L4-935. <br />2. Operator shall maintain internal combustion engines and monitor and <br /> control fugitive dust, during all phases of the operation, to keep same <br /> in compliance with the air pollution and dust emission standards <br /> set by the Colorado Air Pollution Control Commission. <br />3. Nothing in this permit shall subrogate the operator's responsibility <br /> for compliance with local county zoning requirements. <br />i <br />,~~ ,4. Operator shall fence the area covered by this permit for the duration of <br />,~`V.. <br />' ' the permit with a fence of suitable construction to prevent entry <br />~o~.~ <br />~~ onto the subject property by cattle and/or sheep, except that existing <br />~ <br />.~.~ <br />:~ fences shall be maintained atbcomparable standard of strength or <br />'V upgraded to such a standard prior to seeding any land. <br />6. Operator shall stockpile all topsoil on the subject property and if such <br /> topsoil is not replaced, for the purpose of revegetation, within$ two <br /> (2) months then such topsoil shall be planted, as soon as environmental <br /> conditions permit, with a quick-cover annual grass to protect the topsoil <br /> against loss from erosion or deterioration or contamination from <br /> overburden materials. Planting of stockpiled topsoil shall not be <br />I required if it is to be replaced for use in revegetation prior to <br /> the time such annual grass planting could occur or if it is to be <br /> replaced, during the growing season, within 30 days of the last day <br /> of the second month after the topsoil was stockpiled. <br />13. The topso}~ shall be replaced to a depth of not more than 18 inches nor <br /> less thanl inches, smoothed, and prepared for seeding by compacting, <br /> followed by a roughening to a depth of not less than one inch nor more <br /> than four inches. <br />14. Seeding shall occur in April or October and shall be done by drilling. <br /> No fertilization shall be done prior to seeding, but a fertilization <br /> program shall be carried out the first autumn following the first <br /> growing season. <br /> Seeding shall be done according to the following mixture. No grazing, 'except by wildlife, shall be permitted on any re vegetated <br />area until such time that the board approves an initial, controlled <br />and experimental period of grazing to test the capability of the vegetation <br />to withstand a measured and monitored level of grazing impact. <br />17. Operator shall control erosion on or along haul roads by the use of <br />drainage ditches, culverts and check dams. Natural drainways or <br />drainways constructed to alleviate flood conditions in the area shall <br />be kept free from overburden, stockpiles, and topsoil. <br />
