The subsequent map submitted with the adequacy responses contains the same notation, and <br />none of the other materials submitted acknowledged the requirement for a revision to the permit if this area is <br />affected. Please acknowledge the above information. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />5. Rule 6.45 (2) (f) (iii) requires the application to specify types, mixtures, quantities and time of application of <br />fertilizer. The newly submitted alternate reclamation plan does not reflect this information. Please indicate <br />the fertilization information in the alternate reclamation plan. <br />Rule 6.4.7 Exhibit G -Water Information <br />6. The application states that a revised storm water control analysis is being conducted to determine the <br />appropriate design and capacity of the proposed detention pond. The application further states that the <br />Division will be provided with the design specifications as they are received. Please be aware that the <br />Division must receive these design specifications prior to approval of the permit. <br />Rule 6.5 Geotechnical Stability Exhibit <br />Division staff will be reviewing this document separately, and the operator will be notified of any adequacy <br />issues related to this exhibit. <br />Because objections were filed for this Permit, this matter must be set for a hearing before the Mined Land <br />Reclamation Board. The tentative date for the hearing is January 1l or 12, 2006. However, the Division will <br />need to make a recommendation by December 15, 2005 to allow adequate time for procedures required prior to <br />the Board hearing. Please be advised that the Gravel LLC 112(c) Permit Application may be deemed inadequate, <br />and the application may be recommended for denial on December I5, 2005 unless the above mentioned adequacy <br />review items are addressed to the satisfaction of the Division. Responses to these adequacy concerns must be <br />received by the Division to allow adequate time for review prior to the recommendation date. If you feel more <br />time is needed [o complete your reply, the Division can grant an extension to the recommendation date. This will <br />be done upon receipt of a written waiver of your right to a recommendation by December 15, 2005 and a decision <br />by January 12, 2006, and a request for additional time.
