The Division o£ Minerals and Geology ("Division") is currently required to make a recommendation <br />decision no later than mid-December, 2005. This issue is scheduled for the January 11 & 12, 2006 meeting of the <br />Mined Land Reclamation Board. Therefore a letter from the applicant extending the decision date is necessary. <br />A recommendation for the application must be made prior to the pre-hearing conference, regarding the January <br />hearing, which will be scheduled in mid-December, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. Rule 6.2.1(2) requires that maps be prepared and signed by a registered land surveyor, professional engineer, or <br />other qualified person. The Reclamation Map submitted to the Division was not signed or dated. Please submit a <br />signed copy of this map to the Division. <br />Rule 6.4.3 Exhibit C- Pre Minin¢ and Mine Plan Man(s) of Affected Land <br />2. Rule 6.4.3 (d) states that the Pre-Mining and Mine Plan map should reflect the total area tp be involved in the <br />operation, including the area to be mined and the area of affected lands. Rule 1.1(3) defines affected lands as <br />including roads. The access road identified on the map indicates, "Access Roadway to Vary with Mining <br />Direction." This portion of the roadway on the map is paralleled closely by the permit boundary. It is unclear <br />from this notation, whether the operator intends to alter the location of the roadway with the mining direction, <br />or whether this notation conveys some other intent. If the location of the road is altered, it appears that it will <br />fall outside of the permit boundary. Please clarify this notation and be aware that the location of the permit <br />boundary depicted on the Mine Plan Map is fixed, and cannot be altered to accommodate a feature that is <br />moved during the mining operation or that is constructed in a location different from that depicted on the <br />map. Please make the necessary adjustments to this exhibit. <br />3. The inclusion of the above area into the permit will change the total acreage of the mining permit. Based on <br />previous information submitted to the Division with this added acreage, the total acreage of the permit <br />appears to be 212.6. Please confirm or correct this information. <br />4. As mentioned in the previous adequacy review, the submitted Pre-Mining and Mine Plan Map identifies a <br />portion of the permit area as "Possible Affected Area."
