Please review Exhibit J -Vegetation Information. In that section is a field report by <br />Dr. Eric Olgierson and a response to that report and related map by Terry McKee of the <br />USACOE. Mr. McKee states that be is in agreement with the jurisdictional wetland <br />delineation of Dr. Olgierson's. The two ponds you mentioned in your letter of July 14 are, <br />indeed, jurisdictional wetlands. Dr. Olgierson is currently corresponding with the <br />USACOE to determine whether a permit is necessary and if so, what kind, or whether <br />simply a replacement wetlands mitigation plan wilt suffice. Prior to any mining on the <br />site, being herein applied for, a copy of the approval letter from the USACOE approving <br />our permit or mitigation plan will be forwarded to the DMG. <br />2. a. Loading of asphalt is assumed to mean that location at which the asphalt is fed into a <br />truck from the overhead silo. Therefore, Cooley Gravel Company agrees to pour a <br />concrete pad below this silo. The dimensions of this pad will be 6 inches deep, 20 feet <br />long and 8 feet wide. In lieu of the concrete pad, a concrete and steel weighing scale <br />may be placed under the silo. This scale will provide similar spillage protection as that <br />provided by a concrete pad. The pad will be constructed at the same time as erection <br />of the asphalt plant per your request. <br />b.
