RE: Answer to Adequacy Concerns, Longmont Operation, DMG File No. M-94-027.
Dear Mr. Keffelew:
Below are our responses to your Adequacy Concerns as noted in your correspondence dated
July 14, 1994.
The concerns are addressed in the order conveyed to me:
1. Please review Exhibit J -Vegetation Information. In that section is a field report by
Dr. Eric Olgierson and a response to that report and related map by Terry McKee of the
USACOE. Mr. McKee states that be is in agreement with the jurisdictional wetland
delineation of Dr. Olgierson's. The two ponds you mentioned in your letter of July 14 are,
indeed, jurisdictional wetlands. Dr. Olgierson is currently corresponding with the
USACOE to determine whether a permit is necessary and if so, what kind, or whether
simply a replacement wetlands mitigation plan wilt suffice. Prior to any mining on the
site, being herein applied for, a copy of the approval letter from the USACOE approving
our permit or mitigation plan will be forwarded to the DMG.
2. a. Loading of asphalt is assumed to mean that location at which the asphalt is fed into a
truck from the overhead silo. Therefore, Cooley Gravel Company agrees to pour a
concrete pad below this silo. The dimensions of this pad will be 6 inches deep, 20 feet
long and 8 feet wide. In lieu of the concrete pad, a concrete and steel weighing scale
may be placed under the silo. This scale will provide similar spillage protection as that
provided by a concrete pad. The pad will be constructed at the same time as erection
of the asphalt plant per your request.
b. A minimum 2 ft. high berth will be placed around the perimeter of the asphalt batch
plant site prior to operation of the asphalt plant per your request.
