But, you also state that "In the event we cannot <br />cover the groundwater, we will get a water permit to account for our evaporational <br />losses". This may pose a couple of problems: a) If you do expose groundwater and <br />decide to leave a pond, in addition to acquiring a water well permit, you will have <br />to amend your MLRB permit; and b) also, if you decide to leave a pond, it will be <br />awfully difficult to meet your proposed post-mining land use to park equipment, etc., <br />so, here again, you would have to amend your permit. Please commit to amending <br />your permit if you encounter groundwater and decide to leave a pond. <br />8) Exhibit G -Rule 6.4.7(3) and (4) - please provide a description of the project's <br />water requirements (if any) and the sourrz of the water. <br />9) Exhibit R -Rule 6.4.18 -please submit an affidavit or receipt (from the County <br />Clerk and Recorder) indicating the date on which a copy of the application was <br />placed with the local County Clerk and Recorder. <br />10) Exhibit S -Rule 6.4.19 -please provide the Division with a copy of the notarized <br />agreements between Saguache County and the person(s) having an interest in any <br />significant, valuable or permanent manmade structure located within two hundred <br />{200) feet of the affected Lutd [hat the County is to provide compensation for any <br />damage to the structure (farm road, power line, phone line, etc.). If you are unable <br />to reach an agreement, you will need to submit an appropriate engineering evaluation <br />that demonstrates that such structure shall not be damaged by activities occurring at <br />the mining operation. <br />If you have published your notice, please send proof to the Division (a copy of the notice will <br />suffice).
