The items of concern are as follows:
1) The post-mining land use you selected is Industrial/Commercial. I have two
questions (since most of the area around the pit is cropland): a) Is the area zoned
for industrial/commercial sites? If so, please submit documentation showing the
current zoning law; and b) Will the proposed land use be compatible with
surrounding land uses?
2) Exhibit C -Maps/Rule 6.4.3(8) -Please show the owner's name, type of structure,
and location of all permanent or manmade structures contained on the area of
affected land and within two hundred (200) feet of the affected land. Your map
accurately depicts the farm road, power line, etc. The only question I have is does
the phone company have an underground (or above-ground} line running down
County Road 47.5? If so, you must show its location if it is within 200 feet of your
proposed affected area.
3) Exhibit D -Rule 6.4.4(f)(ii) -please describe the nature of the stratum immediately
beneath the material to be mined.
4) Exhibit D -Rule 6.4.4(e)(ii) - please provide a description of the size of each
phase of mining.
5) Exhibit E -Rule 6.4.5(2)(b) - please provide a comparison of the proposed
post-mining land use to other land uses in the vicinity...
6) Please confirrrr, pursuant to Rule 3.1.9(1), that you will protect the topsoil stockpiles
from wind and water erosion by seeding them with at least one of the approved grass
species, if they are not going to be disturbed for more than one growing season.
