Fox <br /> 9-25-78 <br /> I submit to you that this does not sound the same as <br /> Mr. Matthias ' s letter to you dated July 14 , 1978 , which <br /> states, "At this point, there are no present plans to <br /> significantly increase production. " <br /> I also enclose a copy of the table submitted to the Weld <br /> County Commissioners and included in the Operations Stan- <br /> dards required by that Board prior to issuance of a <br /> Special Use Permit to Best-Way Paving Company. Please <br /> note that the figures shown in that table indicate equal <br /> fugitive dust sources under "Present Condition" and <br /> "Maximum of Proposed Operation. " However, I would call <br /> your attention to the lack of inclusion of any figures <br /> dealing with the actual mining operation. I believe EPA <br /> estimates list fugitive dust for a mining operation at <br /> 0. 1 lbs ./ton of product. <br /> I would also call your attention to the "Proposed Operation" <br /> which shows aggregate crushing at 140 ,000 , rather than the <br /> 70, 000 under "Present Condition. " <br /> Listed in the Mining Plan as submitted is acreage and the <br /> anticipated degree of disturbance. Degree of disturbance <br /> from Phase 4 through Phase 11 show over 15 acres in MAJOR <br /> DISTURBANCE, the highest acreage being in Phase 10 at which <br /> time 24 . 1 acres are estimated to be in major disturbance. <br /> Finally, I would also like to point out that Operations <br /> Standard No. 11 as set forth by the Weld County Special <br /> Use Permit says, "A fugitive dust emission permit shall be <br /> applied for and obtained through the Weld County Health <br /> Department. " <br /> Because of the above set forth materials and the require- <br /> ment by Weld County that this company secure a fugitive <br /> dust emission permit, this letter is to request that your <br /> department carefully review this matter to insure that <br /> standards are being met and will be met in this regard. <br /> I will be following your decision in this matter with <br /> interest. <br /> Very truly yours, <br /> Mariana S.
