VALCO as the applicant is also an adjacent landowner. We did <br />not mail a notice to ourselves but have placed the attached notice copy <br />in the application file. Final publication is June 19th. The affidavit of <br />publication will be mailed to you as soon as it is received. <br />EXHIBIT B <br />1. Perhaps the setback from the Arkansas River was not sufficiently explained <br />in the application. The General Map indicates a 100' setback at this time. <br />The Division of Wildlife expressed a concern about a northward progressing <br />bend in the river doing extensive erosion. Exhibit D - Wildlife states <br />"The applicant will take normal protective measures to prevent the river <br />from eroding into the pit area." That statement is hereby amended with this <br />additional phrase added at the end of the sentence "and the 100' undisturbed <br />setback from the Arkansas River."
