Long <br />Division Dueaor <br />Thank you for your prompt response to DMG 2/19/99 adequacy letter. Your response, <br />dated 3/8/99, satisfied most of the adequacy issues previously identified by DMG. <br />However, DMG's continued review of the application and review of the applicant's 3/8/99 <br />response has identified the following additional adequacy issues. Please be advised that <br />the application may be deemed inadequate and may be denied on 4/5/99, unless the <br />following adequacy items are addressed to the satisfaction of DMG. <br />1. Exhibit E -Reclamation Plan On page 2 of the applicant's 3/8/99 response letter, <br />under item 5(b) the applicant states, The intent on the rec/amation of Phase // was for non- <br />native fish habitat... <br />However, correspondence from the US Fish and Wildlife Service, dated 3/8/99, states, <br />...As you are aware, we are concerned about gravel operations within the 50-year <br />floodplain which might result in developing habitat for nonnative warm water fish that <br />compete with endangered native fish in the Gunnison Rivers. <br />The reclamation details for the Phase II area, apparently located within the 50-year <br />floodplain, appears to complement the concerns of the US Fish and Wildlife Service. <br />However, the above referenced wording of the applicant's response indicates that <br />reclamation of the Phase II area will result in non-native fish habitat, which appears to <br />conflict with the concerns of the US Fish and Wildlife Service. Please clarify how the <br />reclamation plan will address the concerns of the US Fish and Wildlife Service. <br />2. Exhibit H -Wildlife Information The application contains a wildlife statement from <br />the Colorado Division of Wildlife (DOW) which satisfies the requirement of Rule 6.4.8(2) <br />and portions of Rule 6.4.8(1). Additionally, DMG has received correspondence from US <br />Fish and Wildlife Service, dated 3/8/99, indicating that the applicant is cooperating with <br />
