Lochhead
6ecutive DVPUO!
Michael B Long
Division Director
Listed below are the adequacy review comments on the above-
captioned permit application which we discussed by telephone today.
1. Pursuant to C.R.S. 34-32-115(4)(d), you need to submit to the
Division, a waiver from the owners of the road corridor to the
'~ C Dv f west, the fence to the north and the power line tower which
~ ~i~~ allows you to mine within 200 feet of those structures (if
~O ~•+~•~ they are within 200 feet of the pit). Alternatively, you can
~ ~'~„~¢ submit verification of an agreement with the owners that any
damage caused by the operation will be compensated for by the
operator. A third option is to demonstrate the operation will
not adversely affect the stability of these structures.
2 Mining Plan - Specify what equipment will be used to excavate,
load and transport the gravel and how this will be done, e.g.
excavated with a front end loader and placed directly into a
haul truck. Will the access road to the permit area be
reclaimed upon completion of the mining activities?
~. State the maximum area to be disturbed at any one time. Types
c`„~t of disturbance are explained in Rule 1.1(13) of the Rules &
(/~ Regulations. Your bond amount will be based on this. Simply
put, this can be broken down into the maximum size of the pit
and the maximum area used for stockpile storage outside the
pit. You can lower the reclamation cost by stating that the
pit will not exceed a designated acreage at any one time.
~4. Mining Plan Map - In addition to the map of existing
disturbance, we need the following: The eastern permit
boundary which was cut off of the mining plan map. Show this
and all land within 200 ' of the permit boundary. Label the
ownership of the land on all sides of the permit. Also show
the maximum anticipated disturbed area throughout the life of
the permit. This will include an outline of all areas from
which gravel will be extracted, the stockpile areas, equipment
storage areas, and the land which will be disturbed while
regrading the highwall.
