EXHIBIT 25 <br />• REVEGETATION SUCCESS ACHIEVED <br />Mining of the Sear No. 1 and No. 2 Mines began in 1935. No record <br />of the timing of the disturbance exists. The total disturbance <br />associated with the two mines was 19.3 acres. The following three <br />factors reduced the extent of the disturbed area associated with <br />the mines: <br />1) New State Highway 133 was constructed "through" the <br />loadout area so this area became the responsibility of <br />the State Highway Department. <br />2) The North Fork of the Gunnison River was relocated to the <br />south which encroached upon the permit area. <br />3) In 1984 Mountain Coal Company increased the size of its <br />mine permit boundary onto what was formerly the Bear No. <br />1 Mine Facilities Area. <br />The above three items reduced the size of the disturbed area <br />associated with the Bear No. 1 and No. 2 Mines from 19.3 to 4.5 <br />acres. <br />The Bear No. 1 and No. 2 Mines were reclaimed during 1982. Three <br />vegetation surveys have been performed on the reclaimed areas. <br />• They were performed during year nine (1991), year 10 (1992) and <br />year 11 (1993) of the reclamation liability period. A copy of the <br />vegetation surveys follows this section. <br />Reclamation standards for herbaceous cover, herbaceous production <br />and species diversity have been established as criteria to <br />determine reclamation success. The Division of Minerals and <br />Geology, 1992 Findings Document, page 25 and 26, delineate the <br />vegetation success standards. <br />The year nine (1991) vegetation survey was performed August 6 - 9, <br />1991 and August 31 - September 1, 1991. The year ten (1992) <br />vegetation survey was performed August 11 - 14, 1992 and August 19, <br />1992. The year eleven (1993) vegetation survey was performed <br />September 3 - 8, 1993. All three of the vegetation surveys show <br />that the vegetation on site meets or exceeds the revegetation <br />success criteria. Years 10 and 11 are considered to be the last <br />two consecutive years of the reclamation liability period as <br />defined in Rule 4.15.7(5). <br />SEDIMENT POND N0. 003 REMOVAL <br />According to Rule 4.05.2(2), sedimentation ponds and treatment <br />facilities for surface drainage from the disturbed area shall be <br />maintained until removal is authorized by the Division and the <br />• disturbed area has been revegetated and stabilized and the <br />6 Rev. 12-08-93 <br />
