Temporary suspension of all activities authorized by this grant re for to an-ad- <br />ministrative proceeding upon a determination by an authorized officer of the <br />Bureau of Land Management that such suspension is necessary to protect the pub- <br />lic health and safety or the environment. <br />10. A rebuttable presumption of abandonment for failure to use this right-of-way <br />for the purpose granted for any continuous five-year period. <br />11. The right of the Secretary of the Interior, or his lawful delegate, to grant <br />additional rights-of-way or permits for compatible uses on, over, under, or ad- <br />jacent to the right-af-way area granted herein. <br />12. Applicable water and air quality standards established by or pursuant to Federal <br />or State law. <br />13. Applicable State standards for public health and safety, environmental protection, <br />and siting, construction, operation, and maintenance, if these State standards <br />are more stringent than the applicable Federal standards for projects of the same <br />or similar purpose as that authorized herein. <br />14. That the grantee shall take all measures necessary to: <br />(a) Protect Federal property and economic interests; <br />• (b) Protect lawful users of the lands adjacent to or traversed by the right-of- <br />way herein granted; <br />(c) Protect lives and property; and <br />(d) Protect interests of individuals living in the general area traversed by the <br />right-of-way who rely on the fish, wildlife, and other biotic resources of <br />the area for subsistence purposes. <br />15. That the right-of-way granted herein cannot be conveyed, assigned, or otherwise <br />transferred, in whole or in part, without prior written approval by the Bureau <br />of Land Management. Any transfer will be subject to regulations existing and <br />such other terms, conditions and stipulations deemed necessary at the time of <br />approval of such transfer. <br />This decision becomes final 30 days <br />to 43 CFR, Part 4, Subpart E.
