<br />SPECIAL STIPULATIONS <br />• Special Stipulations Pertaining to Both the Relocated Road and the Abandoned Roads: <br />1. The Area Manager (the authorized offices), Kremmling Resource Area, P. 0. Box 68, <br />Kr mmling, Colorado 80459, will be notified 1 week prior to commencement of <br />any activities and 1 week after completion of any activities occurring on <br />Federal lands under the authority of right-of-way grant C-29939. <br />2. If, in its operations, the grantee or his contractor discovers any cultural <br />remains, monuments or sites, or any object of antiquity subject to Che Anti- <br />quities Act of June 8, 1906.(34 Stat. 225; 16 U.S.C. secs. 431-433), the Arch- <br />aeological Resources Protection Act of 1979 (93 Stat. 721; 16 U.S.C. 470aa- <br />47011), and 43 CFR, Part 3, the grantee or his contractor shall immediately <br />cease activity and report directly to the Area Manager, Kremmling Resource <br />Area. The Bureau shall then take such action as required under the Acts and <br />regulations. The grantee or his contractor shall follow the mitigation require- <br />ments set forth by the BLM concerning protection, preservation, or disposition <br />of any sites or material discovered. In cases where saivage excavation is <br />necessary, the cost of such excavations shall be borne by the grantee. <br />3. If any historical remains or paleontological fossils are encountered during <br />any activities, all activities will immediately cease and the find will be <br />rep or[ed as soon as possible to the Area Manager, Kremmling Resource Area. <br />No activities will resume until authorized by the Area Manager, hremmling <br />Resource Area. <br />• 4. A seed mixture containing 2 pounds each of antelope bi[terbrush, arriba western <br />wheatgrass, luna pubescent wheatgrass, and oahe intermediate wheatgrass and 1 <br />pound each of arrowleaf baisamroot, dry land alfalfa, indian ricegrass, and <br />lutana titer milkvetch will be evenly drill-seeded at the rate of not less than <br />12 pounds per acre on all disturbed areas. If any seed is broadcast-seeded, <br />the rate will be not Iess than 24 pounds per acre. Concurrent with this <br />seeding, a 100- percent nitrogen fertilizer will be evenly broadcasted at the <br />rate of not less than 150 pounds per acre. All seed and fertilizer will be <br />covered with ~L" to ~" of soil, but no seed or fertilizer will be covered with <br />more than ~" of soil. All seeding and fertilizing will be applied during the <br />fall season between October 1 and November 15. A second application of the sam <br />seed mixture and fertilizer will be applied at the same rate 1 year later on <br />any disturbed areas having less than 30-percent vegetative ground cover. <br />5. The grantee shall comply with the applicable Federal and State laws aryl regu- <br />lations concerning the use of pesticides (i. e., insecticides, herbicides, <br />fungicides, rodenticides, and similar substances) in all activities and/or <br />operations under this grant. The grantee shall obtain from the BLM authorized <br />officer approval of a written plan prior to the use of such substances. The <br />plan must provide the type and quantity of material to be used; the pest, <br />insect, fungus, etc., to be controlled; the method of application; the location <br />for storage and disposal of containers; and other pertinent information that <br />the BLY authorized officer may require. The plan should be submitted ao later <br />than December 1 of any calendar year that covers the proposed activities for <br />the next fiscal year (i. e., December 1, 1980, deadline for a fiscal year 1982 <br />• action).
