---- qua
•
boundary. A graphic representation of the ditch and divider box will be shown on
the revised map.
b.) The power line at the SW comer of Phase 4 leads to the well logted east of the
permit boundary and within the permit boundary. The applicant owns both the
power line and the well. The power line will ba shown on the revised map.
c_) Ownership of these fadlities is shown on Figure C_ As with the other map
changes, we wilt show the outline of the faalities on the revised map and their
ownership.
4 Q ~~ ~` d.} This over flow pipelditch is operated by the North La Junt~.a` Sanitation pistrid who
~~p~'` y`t' have a I®gal easement for this structure to cross the appHCanrs property. We will
u show the location and ownership of the easement on the revised map.
4
F ~ ~. P~ ~ e.) The dike is owned by the applicant within the proposed pennK boundary. A
t (~ ' j graphic representation of the dike will be shown on the revised map.
' f.) The two wells and power line are owned and maintained by David Coulter. who is
shown as the property owner on Fgure C. The power line will be added onto the
revised map along with the ownership of both the wells and power line.
g.) The phone line will be shown on the revised map. However, the line will be
located greater than 200-ft. from the revised affected area as described in t .),
above.
h_) There is no record of ownership Of the ditch, or of an easement for the ddch, in
the County records. Apparently, the ditch has been maintained by the Colorado
Dept. of Transportation (COOT) for approximately 40 years. They apparently
ceased to maintain the ditch beginning a few years ago and a lawsuik ensued in
which the downstream properly owners have recently apparently won and the
responsibility of maintenance is up to CDOT_ Therefore, it is an `apparent
easement for COOT, as is currently shown on the map.
E~ibit D - Mining Plan:
U~ 1 J There is no de-watering planned for this mine. There will 6e water exposed to
evaporative loss and that is the reason for "depletion' to the system. The pit will
be mined'~veY with a dragline.
fi~(. 2.) The revised Mine Plan Map and teal for Exhibit D will show and describe that
mining will not take place within 200 ft. of either side of the seepage/drainage
ditch apparently owned or maintained by COOT. These revisions will be
submitted on or before May 15, 1999_
J~'r3.) The stratum beneath the sand and gravel to be mined is shale.
~----_
4.) A SPCC plan is a potential requirement of the Colorado Dept. of Public Health
!7/'(bre.~~G~s~ ~/~~y and Environment (CDPNE). AS a matter of record, the applicant will r~mply wRh
~~~~ all CDPHE Tegulations and since a Stonnwater Permit will be required for this
-~y~""~~A~~-+`~ ~ G . p~~. to 6 e
d ~l~f0 ! e~ G llLyr Laj" ~ /J~ P~ ~' ~c ~v~- G~ ti/ t i ar-~-
~,..C~ .'lua0loj' ~
