The power line will be added onto the <br />revised map along with the ownership of both the wells and power line. <br />g.) The phone line will be shown on the revised map. However, the line will be <br />located greater than 200-ft. from the revised affected area as described in t .), <br />above. <br />h_) There is no record of ownership Of the ditch, or of an easement for the ddch, in <br />the County records. Apparently, the ditch has been maintained by the Colorado <br />Dept. of Transportation (COOT) for approximately 40 years. They apparently <br />ceased to maintain the ditch beginning a few years ago and a lawsuik ensued in <br />which the downstream properly owners have recently apparently won and the <br />responsibility of maintenance is up to CDOT_ Therefore, it is an `apparent <br />easement for COOT, as is currently shown on the map. <br />E~ibit D - Mining Plan: <br />U~ 1 J There is no de-watering planned for this mine. There will 6e water exposed to <br />evaporative loss and that is the reason for "depletion' to the system. The pit will <br />be mined'~veY with a dragline. <br />fi~(. 2.) The revised Mine Plan Map and teal for Exhibit D will show and describe that <br />mining will not take place within 200 ft. of either side of the seepage/drainage <br />ditch apparently owned or maintained by COOT. These revisions will be <br />submitted on or before May 15, 1999_ <br />J~'r3.) The stratum beneath the sand and gravel to be mined is shale. <br />~----_ <br />4.)
