<br /> <br />Apparently, this ditch has been maintained by the Colorado Dept. of <br />Transportation (CDOT) for approximately 40 years and therefore they may <br />have a prescriptive right to an easement, as described earlier in this <br />response. Due to the confusing ownership and maintenance of this ditch at <br />this time, the applicant has determined that it would simply be easier to revise <br />the mine plan to show a 200-ft. setback from either side of the centerline of <br />the ditch and confine mining to this location. The revised mine and <br />reclamation plan maps will reflect this change upon submittal on or before <br />May 15, 1999. <br />The responses given above should satisfy the concems raised in the CDMG <br />Adequacy Letter of April 12, 1999 for the North River Pit. <br />If you have any questions or concerns, please contact me. <br />Sincerely, <br />;~~r~<~~ <br />Robert B.
