<br />Exhibit L -Reclamation Costs: <br />1.) We concur with this course of action. <br />Exhibit S -Permanent Man-Made Structures: <br />1.) Rule 6.4.19 (Exhibit S) in part reads, "Where the mining operation will adversely <br />affect the stability of any significant, valuable or permanent man-made structure <br />located within two (200) feet of affected land,...". <br />This site will be wet-mined which will generally preclude any issues regarding <br />side-slope stability of the pit walls that would "adversely affect" nearby man-made <br />structures. I will address each structure as listed under Exhibit C, 2., a - h: <br />a. The "divider box" and ditch leading to the box are owned and maintained by <br />the applicant. The ditch will be utilized to convey Ft. Lyon Canal ditch shares <br />to the mined pit area for "make-up" water as part of the Substitute Supply <br />Plan. The divider box and ditch are contained within the 20-ft. wide setback <br />area between the permit boundary and active area of mining. <br />b. The power line and well are owned and maintained by the applicant. At the <br />close of Phase 3 or the beginning of Phase 4, the power line and the well will <br />be dismantled and the area where the well is located will be mined. <br />c. Please see "Exhibit A" attached to this letter (and received previously by the <br />CDMG) that essentially states that the North La Junta Sanitation District is in <br />concurrence with the mine and reclamation plan as submitted to the CDMG <br />for the North River Pit. <br />d. Please see c., above. <br />e. The applicant owns the dike. The dike has been in place for many years and <br />exists to keep out high spring flows or floodwaters of the Arkansas River from <br />flooding the agricultural fields. The dike is contained within the 200-ft. wide <br />riparian setback from the Arkansas River. An approximately 20-ft. wide area <br />of non-disturbance will be maintained between the dike and the active area of <br />mining. No adverse effects due to mining will occur to the dike. <br />The two wells and power line are owned and maintained by David Coulter, <br />who is shown as the property owner on Figure C. Attached as "Exhibit B" is a <br />copy of a letter to the Otero County Commissioners dated March 15, 1999 <br />and signed on April 1, 1999 by David and Alice Coulter that essentially states <br />that they are in concurrence with the mine and reclamation plan as submitted <br />to the CDMG for the North River Pit. If a more definitive letter of agreement <br />with CDMG would be required from the Coulters, this could be arranged. <br />g. The phone line on the south side of State Hwy. 194 will be greater than 200 <br />feet from the affected lands of this mine plan per the revised mine and <br />reclamation plan described earlier in this response. <br />
