<br />boundary. A graphic representation of the ditch and divider box will be shown on <br />the revised map. <br />b.) The power line at the SW corner of Phase 4 leads to the well located east of the <br />permit boundary and within the permit boundary. The applicant owns both the <br />power line and the well. The power line will be shown on the revised map. <br />c.) Ownership of these facilities is shown on Figure C. As with the other map <br />changes, we will show the outline of the facilities on the revised map and their <br />ownership. <br />d.) This over flow pipe/ditch is operated by the North La Junta Sanitation District who <br />have a legal easement for this structure to cross the applicant's property. We will <br />show the location and ownership of the easement on the revised map. <br />e.) The dike is owned by the applicant within the proposed permit boundary. A <br />graphic representation of the dike will be shown on the revised map. <br />f.) The two wells and power line are owned and maintained by David Coulter, who is <br />shown as the property owner on Figure C. The power line will be added onto the <br />revised map along with the ownership of both the wells and power line. <br />g.) The phone line will be shown on the revised map. However, the line will be <br />located greater than 200-ft. from the revised affected area as described in 1.), <br />above. <br />h.) There is no record of ownership of the ditch, or of an easement for the ditch, in <br />the County records. Apparently, the ditch has been maintained by the Colorado <br />Dept. of Transportation (CDOT) for approximately 40 years. They apparently <br />ceased to maintain the ditch beginning a few years ago and a lawsuit ensued in <br />which the downstream property owners have recently apparently won and the <br />responsibility of maintenance is up to CDOT. Therefore, it is an "apparent <br />easement" for CDOT, as is currently shown on the map. <br />Exhibit D -Mining Plan: <br />1.) There is no de-watering planned for this mine. There will be water exposed to <br />evaporative loss and that is the reason for "depletion" to the system. The pit will <br />be mined "wet" with a dragline. <br />2.) The revised Mine Plan Map and text for Exhibit D will show and describe that <br />mining will not take place within 200 ft. of either side of the seepage/drainage <br />ditch apparently owned or maintained by CDOT. These revisions will be <br />submitted on or before May 15, 1999. <br />3.) The stratum beneath the sand and gravel to be mined is shale. <br />4.) A SPCC plan is a potential requirement of the Colorado Dept. of Public Health <br />and Environment (CDPHE). As a matter of record, the applicant will comply with <br />all CDPHE regulations and since a Stormwater Permit will be required for this <br />
