Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: White River City Pit,112c Application No. M-2006-084, Preliminary Adequacy Review. <br />Dear Mr. Lewicki: <br />The Division of Reclamation, Mining and Safety has begun the review of the above referenced 112c <br />application. The Decision,'Date is currently set for May 17th, 2007 provided all issues have been <br />addressed and no objections are received. Please address the following issues: <br />1) Per Rule 1.6.2 (1) (g), the applicant must submit proof of publication and all required notices. <br />To date, the Division has received none of the required notices to adjacent landowners or of <br />publication in the local newspaper. <br />2) Please find enclosed a copy of comments from the Colorado Division of Wildlife from Area <br />Wildlife Manager Bill deVergie. Please respond directly to Mr. deVergie's comments and <br />suggestions and Cc a copy to Division staff. <br />3) Please find enclosed a copy of comments received from the Colorado Historical Society's <br />Georgianna Contiguglia. There is some incomplete data concerning a wagon road in the vicinity <br />of the proposed project. Please respond directly to the Historical Society and Cc a copy to <br />Division staff. <br />4) Within the Mining and Reclamation Plans it is noted that there is shale bedding. Please commit <br />to preventing disturbance to the shale by keeping a 2 foot depth of natural materials over the <br />bedrock. It is understood that exposure will happen from time to time and limiting exposure of <br />shale to air will reduce the likelihood of increased selenium. <br />5) Please verify that selenium will or will not be monitored as part of the NPDES permit. <br />6) In the Mine Plan ifis noted that 200 gpm will be pumped into the adjacent wetlands to prevent <br />the area from drying out. Please clarify when it is anticipated that pumping will begin and also if <br />there is a plan in place to monitor that 200 gpm will be sufficient to protect the wetlands. <br />7) It is noted that the operator will mine vertical up to the buffer zone and then 2:1 to the <br />disturbance edge. Please commit to marking the disturbance edge which is mostly 30 feet within <br />the permit boundaries. Also, the operator needs to delineate the buffer zone where 2:1 sloping <br />must begin. <br />8) Please commit to seeding the topsoil and overburden piles with the approved dry rangeland mix <br />upon placement along the permit edge. <br />9) Please clarify that topsoil will be stored independent of overburden. <br />Office of Office of <br />Mined Land Reclamation ARive and Inactive Mines <br />
