<br />area, as it is collected, to the neighboring pond of the water ski club. The net effect of this <br />discharge will be to recharge groundwater in the immediate, downgradient area of the <br />mine. <br />5. On Page 8, the applicant states that water in the collection pond will be clarified and <br />discharged into the ditch. Please state what ditch will be the discharge point. <br />The Applicant has made provision to discharge to the Fulton Ditch, which runs along the <br />mining property's western boundary. Any discharge to the Ditch will be in accordance with <br />the Crossing Agreement, which is attached to this response and has been executed <br />between the Fulton Irrigating Ditch Company and Dacoa, Inc., and in accordance with a <br />CPDS discharge permit to be issued by the CDPHE -Water Quality Control Division. <br />The Applicant also proposes to have the ability to discharge directly to the lake of the <br />Henderson Water Ski Club, located west of the mine. <br />6. Please state the overall depth of the pit during mining and reclamation. <br />The floor of the existing mining depression is approximately 25 to 30 feet below ground <br />surface. The Applicant expects to remove 500,000 cubic yards of residual material from <br />the mine, corresponding to 8 to 14 feet of depth and then expects to remove 3 to 4 feet of <br />claystone bedrock to create a reservoir liner with the appropriate slopes. The final depth <br />of the mine and resulting rLSServoir will be at approximately 35 to 40 feet below ground <br />surface. <br />The applicant makes note of an existing topsoil pile located on site. Please locate this pile <br />on the map. <br />During previous mining operations, topsoil was gathered in the southwest quadrant of the <br />mining area - in that area which is now above water level. To some extent, this topsoil <br />has been mixed with overburden and residual sand and gravel. When the Applicant <br />begins activity in this area of the mine, he will consolidate as much topsoil as practical <br />near the center of the pit, as indicated by the Mine Plan Map. <br />Rule 6.4.5 Exhibit E-Reclamation Plan <br />8. The applicant proposed to reclaim the site as a clay lined water storage reservoir. <br />Enclosed, please find a copy of the Division's guideline titled, "Guide to Specification <br />Preparation for Slurry Walls and Clay Liners as a Component of a Colorado Mined Land <br />Reclamation Permit." As noted in this guideline, operators may choose the option to bond <br />for 100% installation or replacement cost of a slurry wall or pit liner or may select a <br />regulated construction option and become eligible fora 20% installation or replacement <br />bond. The guideline contains information that must be submitted by the applicant to be <br />eligible for the 20% bonding option. Please inform the Division if the applicant intends to <br />bond for 100% of the clay liner, or will provide the necessary information for the 20% <br />bonding option. <br />The Applicant has elected to bond for 100 percent of the installation cost of a clay liner. <br />9. The applicant proposes a 6" topsoil replacement depth on the reclaimed shoreline of the <br />pit (approximately 3 acres in size). Due to the nature of the natural topsoil depth as noted <br />
