<br /> <br />Response to Adequacy Review <br />124"' Estates Sand and Gravel Mine, File Number M-2001-085 <br />As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice <br />circulated in the local newspaper and all owners of record of surface lands, and easement <br />holders that are on the affected land and within 200 feet of the boundary of the affected <br />land. Proof of notice maybe return receipts of a Certified Mailing or by proof o/personal <br />service. <br />Proof of publication and proof of notice to owners of record are attached to this response, <br />as Attachment 1. <br />2. Rule 6.2.1 (2) requires that maps be signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit a signed copy of the maps. <br />Signed copies of Exhibit C-1 (Pre-Mine Plan Map -Man Made Features); Exhibit C-2 (Pre- <br />Mine Plan Map -Natural Features); Exhibit C-3 (Mine Plan Map); and Exhibit F <br />(Reclamation Plan Map) are attached to this response as Attachment 2. <br />Rule 6.4.3 Exhibit C -Pre-Minino and Mining Plan Map(s) of Affected Lands <br />3. Exhibit C-1: Pre-Mine Plan Map (Man Made Features) lists the adjacent property owners. <br />The Division was unable to locate the name and address of property owners to the east <br />side of the site and to the north (area north o(the site access across 124"' Avenue). <br />Please state the name and address of the adjacent land owners. <br />Exhibit C-1, attached to this response, includes a complete list of adjacent property <br />owners keyed to their property on the drawing. <br />Rule 6.4.4 Exhibit D-Mine Plan <br />4. The applicant states that a dewatering sump and settling ponds will be constructed within <br />the pit. Please describe the dimensions of the pond, describe any impacts to the <br />surrounding surface water and groundwater systems and state how the ponds will be <br />reclaimed. <br />Two ponds will be excavated into the floor of existing mining pit to collect and allow <br />clarification of water before discharge to the Fulton Ditch or to the neighboring Henderson <br />Water Ski Club. The ponds will be constructed within the southwest quadrant of the pit. <br />Each pond will be approximately 100' x 400' and will be expected to "self seal" due to the <br />effect of fine solids settling and lining the walls of the ponds. The relatively large size of <br />the ponds will allow discharge to be equalized to accommodate the requirements of the <br />Fulton Irrigating Ditch Company and/or the Henderson Water Ski Club. <br />The Applicant acknowledges that dewatering of the mining area will likely have an impact <br />on local groundwater levels. The short duration of dry mining activity, the concurrent lining <br />of the mined area, and mitigation steps, discussed later in this response, should minimize <br />these impacts. Dewatering ponds will not add to the potential impacts to groundwater but <br />will contribute to the mitigation of impacts by allowing discharge of water from the mining <br />
