Cottony <br />Division Director <br />Natural Resource Trustee <br />On October 11, 2005, DMG found the above referenced application complete for the purposes <br />of filing. Pursuant to Rule 1.4.6(1), the decision date was set for November 10, 2005. The <br />public comment period for the application closed on November 7, 2005. During the comment <br />period, DMG received an objection to the application from the Animas River Stakeholders Group <br />(ARSG) and informal comments from the Bureau of Land Management (BLM). Copy of the <br />timely objection and comments were forwarded to you previously. On November 10, 2005, <br />DMG determined the application to be complex, as defined by Rule 1.1(10), and pursuant to <br />Rule 1.4.1(7), extended the decision date to January 9, 2006. <br />Please be advised that the permit application may be deemed inadequate, and your application <br />may be denied on January 9, 2006 unless the following adequacy review issues are addressed <br />to the satisfaction of the DMG. <br />Adequacylssues <br />1. The permit area is located on the outside of a turn in the river channel, where erosive <br />energies are concentrated. Much of the 50-foot buffer separating the excavation area from the <br />low water channel is void of substantial vegetative cover and composed of unconsolidated <br />alluvial materials. The proposed excavation will extend to 15-foot depth, well below the <br />elevation of the adjacent river channel. Evidence of active erosion of the riverbank, adjacent to <br />the proposed permit area, was observed during the pre-operation inspection. Due to the <br />proximity of the proposed excavation to the river channel and unconsolidated nature of the <br />material between the river channel and excavation, there appears a potential for the current <br />erosion of the riverbank to advance into portions of the excavation area. Should the river erode <br />into the excavation area the Operator may not be able to complete the proposed reclamation. <br />Additionally, due to the depth of excavation, the pit area will become a bedload deposition area <br />with potential for associated headword erosion and downstream scour from sediment hungry <br />water. Such erosion appears to have the potential to advance beyond the proposed permit <br />boundary. Pursuant to Rules 3.1.5(3), 3.1.6(1) and 6.3.3(1), please describe what measures will <br />be taken to minimize disturbances to the hydrologic balance, prevent off-site damage, and <br />provide for a stable configuration of the reclaimed area consistent with the proposed future land <br />use. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
