Cattany <br />Division Direcor <br />Natural Resource Trustee <br />RE: 2"d Adequacy Review Comments -File Pit 112 Application, File No. M-2004-047 <br />Class: Permit <br />Dear Mr. File: <br />Listed below are remaining adequacy review comments on the above-captioned Regular 112 <br />Application for 314.14 permitted acres. The decision date for your application is scheduled for <br />February 28, 2005. Therefore, I would appreciate a response from you on or before February <br />25, 2005. (Your response should include two (2) copies). For your benefit, we have listed <br />adequacy concerns with the same numbering sequence as in the Division's previous adequacy <br />review letter of October 7, 2004. Please be advised that your conversion application maybe <br />deemed inadequate and the Division may recommend denial on February 28, 2005 unless the <br />following adequacy review items are addressed to the satisfaction of the Division. <br />6.4.5 EXHIBIT E -Reclamation Plan <br />6. On page 5, the applicant specifies that a large berm above natural grade will be constructed as <br />part of the south reservoir and will impound more than 100 acre-feet of water. Please clarify the <br />height and width of the proposed berm (or provide representative cross section), and include an <br />itemized cost for construction of the berm in Exhibit L -Reclamation Cost. Please provide. <br />9. The weed control program proposed by the operator specifies that weed control methods will <br />be employed following re-vegetation. The Division requests that the applicant commit to <br />applying weed control methods, such as mowing and/or spraying with herbicides, on an as- <br />needed basis during all phases of the operation. Please respond. <br />10. The applicant has referenced the liner design to be employed at the File Pit 112 operation will <br />be the same as the liner design provided in Permit M-2003-090. Review of the permit file for M- <br />2003-090 indicates that the liner design was provided in Exhibit E -Reclamation Grading Plan. <br />Please provide a copy of the representative cross sectional liner design to be employed at the File <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
