The Pemmittce has nmade a showing satisfactory to the Board: 1) that it will employ, during and <br />after its underground mining and/or surface operations, procedures designed to mmim~ environmartal <br />disturbance from such operation; 2) that it will provide for reclanmation of the Affected Lands appropriate ro dine <br />subsequent baneficial use of such lands; and 3) that, m the evert ofthe failure of its proposed reclamation plan, it <br />will take whatever measuns may be necessary to assure the success of reclamation of the lazmds affected by such <br />operations in accordance widen the Ad. <br />F. A wry of the Pemmittee's application, as amended and supplerrramted, has beam approved by the <br />Board and is, by this referprmce, incorporated herein. <br />G. The issuance of this permit does nd relieve you from having to comply widen all apphcable <br />Federal, State and County statutes, including State water law. <br />GRANTS. CONDITIONS AND AGREEMENTS <br />The Board, in reliance upon the rm~mresartations and promises mmmade in the permit appliption, as <br />amamded and supplemented, and the perfommance warranty, hereby issues a life of the mine pemmit ro the <br />Permittee, to engage um the operations described in the apphcaton on certain (ands lying im the County of Park, <br />State of Colorado. These larmds are described in the permit application, as amended and supplemented, and are <br />referred to herein as the "Affected Lands". <br />This pemmit is issued subject to the following camditions and agreammarts <br />l) The Pertnittee will be botmd by all apphcable requirements of the Ad, and all applicable Hiles <br />and regulations of the Board, as amamded from time to tune, the terms of the pemtit application, the remms of the <br />perfommance warranty, and the terms ofthe financial warrurty filed with the Division. <br />2) The Permittee will file widen the Division its annual report and flees on each ammiversary date of <br />this pemmit. <br />3) If analyses of the mining and reclamation operation and the data collected through monitoring <br />and experimartation by the Permittee or monitoring by the Division indicate that the operation will not be able to <br />comply with the requirentarts of the Ad and applicable rules and regulations of the Board, the Permnittee hereby <br />agrees to exercise its best efforts, after consulting with the Division, to modify the plans to correcx sudm <br />deficiencies in the firture. Such modifications may require technical envisions or anmeamdmamts to the pemmi. <br />4) The Board, or its authomized representative may inter upon the lauds of the permitted operation <br />at all reasonable times for the purpose of inspection to detemmine whether the provisions of the Ad, Rules and <br />Regulations, and pemmit have been canmplied with pursuant to C.R.S. 34-32-121. <br />5) This pemmit may be revoked or suspamded for non~liance widen the Ad or apphcable Hiles <br />or regulations promulgated by the Board, the pemmit, or by violation of a Board Order. <br />
