SECTION E - IMPACTS AND RECLAMATION
_ _~

Further Land Development
Most of the land development in the area
to the Colorado Open Mining Land Reclamation
which states at 92-36-5:
is now subject
Act of 1973,
"Preservation of Commercial Mineral Deposits for Extraction.
(1) After July 1, 1973, no board of county commissioners,
governing body of any city and county, city or town, or
other governmental authority which has control over zoning
shall by zoning, rezoning, granting a variance, or other
official action or inaction, permit the use of any area
known to contain a commercial mineral deposit in a manner
which would interfere with the present or future extraction
of such deposit by an extractor."
Much of the area is included in the survey of commercial
mineral deposits in the populous counties of Colorado, as
stated in the State Geological Survey, Department of Natural
Resources Special Publication 5-A,
Aeereeate Resources Colorado: Front
es
Under this constraint, therefore, further development in
the area will require extraction of the proven existing mineral
deposits as a first step.
Conclusion
The recent historic land use in the subject area has been
pasture - vacant, or open space Flood Plain.
Weld County under past and present planning policies and
practice has encouraged "open"-agricultural uses in the subject
area.
Weld County has also encouraged "protection" and mining
activities in Mineral Conservation and Flood Plain areas,
through its County Comprehensive Plan of 1973 and also County
Mineral Resources Extraction Plan - Volume II, July 1975.
As it seems logical that this already established "open"
- Flood Plain - Mineral Extraction policy would continue, re-
inforced by state policy (laws), we believe that our mining
and subsequent reclamation activites are in line and compatible
with present and future land use policies of the state and
county.
-5-
