On Apr11 24, 1974, the lease sale for Lease C-22644 was held. Energy <br />Fuels was the successful bidder. Mining on this tract must await the <br />• approval of this application. <br />Necessity For Permit and Mine Plan and Exploration Plan Approval. <br />All of Energy Fuels' operations are covered by Extraction and Develop- <br />ment Permit Number 76-16 issued by the Colorado Mined Land Reclamation <br />Board ("NLRB"). This permit has been amended to effect compliance with <br />the Interim Regulatory procedures pursuant to Section 502 of the Surface <br />Mining Control and Reclamation Act and the Interim Regulations at 30 CFR <br />Section 700.1 et seq. In addition, Energy Mines No. 1 and 2, the only <br />Energy Fuels' mining operations where Federal Coal is being mined, are <br />included within an approved Federal Mining Plan pursuant to the regula- <br />tions at 30 CFR Section 211.10. <br />This application represents a request for a modification of Energy <br />Fuels' existing Federal mining plan as well as an application for a <br />• permit or permit amendment, as appropriate, from the Colorado Mined Land <br />Reclamation Board pursuant to the recently enacted Colorado Surface Coal <br />Mining Reclamation Act, CRS 1973, Section 34-33-101 et se The net <br />effect of this request for various regulatory approvals and permits is <br />to allow for the mining of a new area encompassed within the recently <br />issued Federal Coal Lease C-22644 and to bring Energy Mines No. 1 and 2, <br />as expanded, into compliance with the Permanent Regulatory Program and <br />the new Colorado Act. <br />Also, this application includes an exploration plan which covers areas <br />adjacent to the planned mining areas for the preparation of additional <br />detailed geologic data. <br />Without regulatory approval of this application by January 1, 1980, <br />Energy Fuels' coal production will plummet and its' operations will be <br />severely curtailed. Jobs will be lost and further shortfalls will occur <br /> under our existing contracts. If Energy Fuels, as the largest employer <br />• in Routt County, is forced to curtail or halt current surface mining <br />-19- <br />
