This ruling applies only to water diverted from <br />somerswt Water Supply System under the decree described above for <br />use of the Sanborn Creak Mine (referred to in Case No. 93 CW 97 <br />as the Smm~raet Mine1 and the unincorporated Tcwn of Somerset. <br />It does not relate in any way to Bear Well No. 1 or any water <br />previously used by Bear Mine described in the application and <br />decree in Caee No. 93 CW 97. (Bear Well No. i is owned by <br />Applicant, but is nor. presently being utilized. Applicant <br />understands that it may not be used in the future unless it ie <br />included within a euUst.i.r.Tire water supply plan approved by the <br />State Engineer or a plan for augmentation approved by the water <br />court.) These consumptive uses <br />are first offset by the a~+glicntion of dry-up ,credits approved in <br />Casa No. 93 CW 97 as described hereinabove. <br />East Beckwith Reservoir No. 2 ie located at the headwaters <br />of Ruby Anthracite creek, a branch of Anthracite Creek, <br />approximately 14 miles above the confluence of Anthracite Creek <br />and Muddy Creek, (becoming Lhe NOith Fork Qf Lhe Gunnison River), <br />and approximately 19.5 miles above Somerset Water Supply System. <br />Assuming transit leases of 50R and an irrigation efficiency of <br />464 (i.e., 54~ of irrigation water returned to stream), Applicant <br />shall release 4.35 acre tact of water from East Beckwith <br />Reservoir for every 1 acre Eoot of water required to replace out- <br />of priority diversions, net of the dry-up credit, through the <br />Somerset water supply System at such time as a call on the river <br />would tie made.
