A list of each parties' exhibits or documents to be used as evidence <br />You will be afforded an opportunity to discuss the draft order with the Pre-Hearing Conference Officer. <br />A copy of the final draft Board Order will be delivered to all parties to the hearing at least three (3) <br />days prior to the Board hearing. <br />DNISION RECOMMENDATION <br />The Division has found that Agile Stone Systems, Inc.'s application for [he proposed Pazkdale Project <br />112 permit meets the requirements of the Colorado Land Reclamation Act For the Extraction of <br />Construction Materials C.R.S. 34-32.5-101 et sec .. and the Board's Construction Materials Rules and <br />Regulations. In accordance with Rule 1.4.5(6), the Division recommends that the application be <br />approved with the following stipulations. <br />The operator will monitor two of the IS individual or multiple spring sources that were mapped <br />by Azurite, Inc. located on the north side of the Arkansas River on asemi-annual basis for tlow <br />rate fluctuations and include the results of that monitoring with the Annual Report. If a <br />significant flow rate decrease is observed which is above 20% and not associated with a dry <br />season for the region, the operator must investigate the cause of the drop in flow rate and also <br />promptly submit a report of it's findings to the Division. In addition, [he two monitoring wells <br />along the southern boundary of the permit area must be measured for static water elevation on a <br />semi annual basis and those measurements included with the Annual Report. Any significant <br />drop in static water elevation that is not associated with seasonal conditions must be <br />investigated and a report of the results of the investigation must also be promptly submitted to <br />the Division. <br />2. The bentonite clay liner of the fuel storage area will be compacted to a permeability of 1 x 10-6. <br />The results of 4 evenly spaced permeability tests of the liner performed by a certified <br />geotechnical engineer must be reviewed and approved by the Division prior to the gravel liner <br />being placed. <br />3. Any significant fuel spills outside the containment area will be reported to the Division within <br />24 hours. Agile Stone Systems will send to the Division, as soon as practicable, a report on the <br />mitigation of any potential pollution of the ground water system, due to the spill. <br />The following is a list of issues that were presented in a timely manner by commentors and objectors to <br />the application. Rationale for Division recommendation of approval over objections will be presented <br />as a separate document at the Pre-Hearing Conference. <br />ISSUES IDENTIFIED PRIOR TO THE TIME OF THE INFORMAL CONFERENCE <br />
