Nielsons agree to comply with all applicable federal, <br />state, county and municipal laws and regulations in conducting <br />its operations upon the Leased Premises. <br />13. Nielsons specifically agree that they acknowledge <br />they are solely responsible for the safety of irrigation ditches <br />which may cross the Leased Premises, and shall protect the exis- <br />tence of such ditches and the ability of such ditches to carry <br />water for the benefit of the persons entitled to carry water <br />therein. <br />14. During the term hereof and upon the expiration <br />thereof, Nielsons shall keec• the Leased Premises in a clean and <br />orderly condition and, but not by way of limitation, shall: <br />a. Separately stockpile all topsoil which may <br />be removed from the Leased Premises. <br />b. Stockpile and backfill in excavations all <br />I <br />h <br />debris and cover the same with earth. <br />c. Comply with all environmental controls, <br />conditions and burdens imposed by any governmental <br />authority having jurisdiction of the same. <br />15. Nielsons shall be responsible to obtain appropriate <br />zoning to conduct its operations hereunder. Lessors agree they <br />will cooperate with Nielsons in its efforts to accomplish such <br />zoning, but shall not be obligated to share any expenses with <br />respect thereto. In the event appropriate zoning to accomplish <br />the purposes hereof cannot be obtained, Nielsons shall not be <br />obligated to continue this Lease, but may terminate the same <br />upon ten (10) days' written notice to Lessors. In the event <br />such zoning is not obtained on or before six (6) months from <br />date, this Lease shall automatically terminate. <br />16. The provisions hereof shall extend to and be binding <br />upon the heirs, representatives, successors and assigns of the <br />parties; provided, however, Nielsons shall not assign or sublet <br />-5- <br />
