t • _2 • <br />r <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute a <br />violation of C.R.S. 1973, 34-32-123 and 124, as amended (1976 Sess. Laws, <br />H.B. 1065). <br />CEASE AND DESIST ORDER <br />Based upon the foregoing findings of fact and notice of violation <br />and pursuant to the provisions of C.R.S. 1973, 34-32-123 and 124, the Board <br />hereby orders you to: <br />1. Immediatley cease and desist all sand and gravel operations <br />described in Item 1, Finding of Fact, and any other unpermitted operations. <br />2. To perform any work necessary to continue reclamation work, to <br />preserve topsoil, and to submit a permit application to the Board for each <br />operation listed on or before June 23, 1977. <br />3. To give written notice within one (1) day after receipt of this <br />notice to the Mined Land Reclamation Board of your compliance with paragraph <br />one (1) of this cease and desist order. <br />4. To submit to the Board within ten (10) days after receipt of <br />this order a proposed schedule of compliance designed to meet the requirements <br />of paragraph two (2) of the order, the legal description of the premises, <br />and a statement disclosing the names, address and nature of interest of all <br />persons who have an interest in said property. <br />If you wish to request a hearing before the Board, you must submit such <br />a request to the Board in writing no later than twenty (20) days after service <br />of this order. In clarification of the rights of recipients.of notices of <br />violation, cease and desist orders, parties are advised to consult the Colorado <br />Mined Land Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain <br />acts to be performed within a certain time, shall be construed as a permit or <br />license either to violate any provisions of the Mined Land Reclamation laws and <br />regulations promulgated thereunder to to engage in any prospecting or mining <br />operations within the State <br />
