EXHIBIT A <br />LEGAL DESCRIPTION <br />That part of the South half of the South half of Section 10 lying West of the center line of Fountain Creek <br />and East of the Denver and Rio Grande Railroad right of way. <br />That part of Section 15 lying East of the Denver and Rio Grande Railroad right of way and West of the <br />center line of Fountain Creek. <br />That part of Section 14 lying West of the center line of Fountain Creek. <br />That part of the Northeast quarter of Section 22 lying East of the Denver and Rio Grande Railroad right of <br />way. <br />That part of the Northwest quarter of Section 23 lying East of the Denver and Rio Grande Railroad right <br />of way; <br />all in Township 17 South, Range 65 West of the 6`h P.M. , EI Paso County, Colorado; <br />But excepting the following tracts of land (to the extent within the boundaries of the above-described real <br />property): <br />1. A one acre square tract in the Northeast corner of the Northwest quarter of the Northwest quarter <br />of Section 14 conveyed to School District No. 28 by instmment recorded October 23, 1902 in <br />Book 331 at Page 444. <br />2. That portion of the Northwest quarter of the Northwest quarter of said Section 14 described as <br />follows: Beginning at the Northwest comer of said Section 14; thence South 270 feet; thence <br />East parallel with the North line of said Section 14 to the West line of said excepted one acre <br />tract; thence at right angles North 270 feet to the North line of said Section 14; thence West along <br />the North line of said Section 14 to the place of beginning, said tract having been excepted from <br />conveyance by instrument recorded October 24, 1945 in Book 1079 at Page 384, <br />3. All that part thereof heretofore conveyed to the Department of Highway, State of Colorado, by <br />deeds recorded in Book 1597 at Page 202, and Book 1623 at Page 221 of the records of the <br />County Clerk and Recorder of EI Paso County, Colorado, and excepting easement conveyed to <br />the Department of Highways, State of Colorado by easement recorded in Book 1623 at Page 223 <br />of said records. <br />TOGETHER WITH an easement on, over and across a strip of land 100 feet in width lying adjacent to <br />and East of the Denver and Rio Grande Railroad right of way within those lands of Grantor in the East <br />half of Section 9 and Southwest quarter of Section 10, West of the Centerline of Fountain Creek and East <br />of the Denver and Rio Grande Railroad right of way, T. 17 S., R. 65 W., for a roadway to provide access <br />to the above-described Property from Old Pueblo Road. In addition to the foregoing 100 foot wide <br />roadway easement, Lessor shall grant Lafarge such additional or altered easement across Lessor's lands <br />as Lafarge reasonably requires at the northerly end of the above-described strip, pursuant to the conditions <br />of its permits authorizing sand and gravel mining on the Property and entry to and from Old Pueblo Road, <br />and afrer consultation with Lessor, to construct, use and maintain the intersection of Lafarge's roadway to <br />Old Pueblo Road in accordance with permit requirements, to be evidenced by an addendum to this Lease <br />executed by both parties upon completion of construction of such access road and intersection; <br />
