B&B Excavating, Inc Montgomery Pit
Mlr File NO. M-86-104, Adequacy Response (cont)
site will be. The bond covers the disturbance caused by
mining and associated uses for this pit.
11. That was part of the Special Use approved by Eagle County on
July 22, 1986.
Exhibit E- Reclamation Plan
1. The division of Wildlife representative stated broad casting
sagebrush with the seed mixture would be sufficient in bringing
back the sagebrush for winter range. He did not recommend
the rate to be used. We did not designate any areas as "sagebrush
habitat area". B&B chooses not to use bitterbrush, service
berry and mountain mahogany.
2. We did that when we stated the trees would be planted along
the ditch. Mr. Heicher of the DOW suggested using willows to
help improve the riparian habitat along the new ditch and we
will do that. In addition we stated that trees would be replaced
for the first three years and then the plantings would be
monitored, other wise we may be replacing trees until the 22nd
century trying to get the reclamation bond released.
3. We will using the SCS recommendations unless the Staff would
like Guarantee in writing their seed mixture will grow, in
which case we will gladly switch. On the other hand it is
after all, the operators cesponsibility to "... establish a
diverse, effective and long lasting vegetation cover that is
capable of self-regeneration...". (CRS 34-32-116(1)(f)(a))
4. Where it runs down the 2h:ly south mine slope it will be
riprapped with native material. In the mine floor a depressed
shallow bed will be constructed so as to better contain any
water coming down the drainage. In addition this will slow
down erosion in the drainage.
Exhibit F Reclamation Plan Map.
1. The attached map shows the riparian habitat to be disturbed
during mining. Mr Heicher recommends:
1) Enhancing the existing riparian habitat area by placing
new vegetation along the river, where this vegetation doesn't
exist or is sparse and
2) Placing new riparian vegetation along the ditch.
This is reasonable and will be done by B&B Excavating, Inc.
4
