be submitted to the U.S. Fish and Wildlife Service and the U.S. Army Corps of Engineers <br />under Section 7 consultation. This plan will enhance and expand the habitat along the Big <br />Thompson River. <br />(b) A comparison ojthe proposed post-mining land use to other land uses in the vicinity and to <br />adopted state and local Zand use plmts and programs. <br />The surrounding land uses currently include agricultural uses to the north, south, east and <br />west. To the south is Frontier Commercial Center and Milliken Corporate Center, which are <br />commerciaUlight industrial developments. The Town's wastewater treatment plant is <br />surrounded by the property on three sides. The proposed ponds and water storage reservoirs <br />will be consistent with the surrounding agricultural uses as well as the commerciaUlight <br />industrial uses to the south. The portion of the site labeled as future development will be <br />developed as amixed-use planned unit development in compliance with the Town of <br />Milliken's Comprehensive Plan and Land Use Regulations. <br />(c) A description of how the Reclamation Plan will be implemented to meet each applicable <br />requirement of Section 3.1. <br />• The Operator will carry all reclamation to completion with reasonable diligence, and each <br />phase of reclamation shall be completed within five years from the date the Operator <br />informs the Board or Office that such phase has commenced. <br />• Hall-Irwin will comply with all reclamation measures set forth in Section 3.1.5: <br />^ Grading will create a final topography that is appropriate for the anticipated future <br />land use. <br />^ Grading will be performed to help control erosion and siltation of the affected lands. <br />^ Backfilling and grading shall be completed as soon as feasible after the mining <br />process. <br />^ Any drill or auger holes that are part of the mining operation shall be plugged with <br />non-combustible material, which shall prevent harmful or polluting drainage. <br />• Maximum slopes and slope combinations will be compatible with the configuration <br />of surrounding conditions and selected land use. All slopes will be compatible with <br />specified MLRB standards. <br />• Mined material to be disposed of within the affected area will be handled in such a <br />manner so as to prevent any unauthorized release of pollutants to the surface drainage <br />system. <br />• Hall-Irwin will comply will applicable Colorado water laws governing injury to existing <br />water rights and with applicable state and federal water quality and dredge and fill laws <br />and regulations. <br />• The Applicant will stabilize and protect all surface areas of the affected land, including <br />spoil piles so as to effectively control erosion. <br />• Hall-Irwin will comply with all standazds and conditions applicable to classified and <br />unclassified groundwater. <br />• Hall-Irwin will protect the existing and "reasonably potentiaC' future uses of <br />groundwater. Hall-Irwin has applied for a well permit and temporazy substitute supply <br />plan to augment evaporative loss from the ponds.
